Disertační práce se věnuje praktickým problémům, které vznikají při vnitrostátním doručování písemností v civilním sporném řízení v kontextu realizace práva na spravedlivý proces a práva být slyšen. Hlavním cílem práce je za pomoci práva na spravedlivý proces a práva být slyšen nalézt uspokojivé řešení problému, které je aplikovatelné v praxi. Objekt zkoumání představují dvě základní oblasti, na straně jedné problémy při doručování písemností prostřednictvím doručujícího orgánu a na druhé straně problémy při doručování dokumentů prostřednictvím veřejně datové sítě. Autor tak zaměřuje pozornost např. na doručování písemností pomocí fikce doručení na úřední adresu či doručování specifickým skupinám osob (osoby nezletilé nebo stižené duševní poruchou) a dále problémy související s datovou schránkou a tzv. "e-mailem".This dissertation deals with the practical problems, which arise in the process of the internal service of the legal documents on the parties during the civil proceeding in the context of the right to a fair trial and the right to be heard. The main goal of this writing is to find the acceptable solution of this problem with the help of the right to a fair trial and the right to be heard, which is applicable in practice. The object of the research is represented by two fundamental fields. On the one hand it is the field represented by the problems arising during the service of the legal documents on the parties by the delivering institution (e.g. postal service), on the other hand it is the field represented by the problems arising during the service of the legal documents on the parties by the Internet. The author turns its attention for example to the service of the legal documents with the use of fiction of delivery to the registered address of the party, or to the service of the legal documents on the specific groups of parties (those who are underage or mentally handicapped), or to the problems related with the data mail box and with the e-mail.
