Předkládaná diplomová práce se zabývá rozsahem materiální a procesněprávní imunity poslanců a senátorů Parlamentu ČR. V úvodu se diplomová práce zaměřuje na samotné vymezení pojmu imunity členů Parlamentu ČR a vysvětlení obou jejich forem. Následně jsou uváděny důvody, které vedly k právnímu zakotvení imunity členů zákonodárných sborů s ohledem na jejich původní smysl a význam, přičemž následně je rozebírána historie právní úpravy imunity od vzniku Československé republiky do přijetí současné Ústavy ČR, která nabyla účinnosti v roce 1993. Další kapitoly diplomové práce se již zaměřují na konkrétní právní úpravu imunity poslanců a senátorů v českém právním řádu, výklad jednotlivých ustanovení Ústavy a také významná soudní rozhodnutí, která byla v této oblasti vydána. Diplomová práce se také zabývá nezbytností existence imunity poslanců a senátorů v současné době. V závěru jsou poté shrnuty názory na výklad, judikaturu a nutnost existence materiální a procesněprávní imunity s ohledem na naplňování jejich původního smyslu a účelu.This presented thesis deals with extent of material and procedural immunity of deputies and senators of the Czech Parliament. Introduction of this thesis focuses on the definition of terms immunity of members of the Czech Parliament and explains both forms of immunity. Subsequently, given the reasons, that led to the legal grounds of immunity of members of legislatures with regard to their original meaning and significance. Then thesis analyze the history of regulation of the immunity since the formation of the Czechoslovak Republic to the adoption of the current Constitution, which came into force in 1993. Next chapters of this thesis focuses on specific legislation of the immunity of deputies and senators in the Czech legal order, interpretation of provisions of the Constitution and also significant judicial decisions that have been published in this area. This thesis also reflects on the necessity of the existence of immunity of deputies and senators nowadays. The conclusion summarize views of the interpretation, jurisprudence and the needs for existence of material and procedural immunity with respect to the implementation of their original meaning and purpose.
