Diplomová práce se zabývá lidskoprávní problematikou povinného očkování dětí z pohledu rodičů. Je zaměřena na danou problematiku pohledem ochrany veřejného zdraví, ale i nejlepším zájmem dítěte. Práce se zabývá přístupem Evropského soudu pro lidská práva, Soudního dvora Evropské unie a Ústavního soudu České republiky k povinnému očkování s ohledem na ochranu veřejného zdraví. Zejména hodnotí přístup Ústavního soudu a stanovuje hlediska, kterými se měl zabývat při poměřování práv. Dále zjišťuje, zda je možné odůvodnit zásah v podobě povinného očkování do práv rodičů nejlepším zájmem dítěte. Práce je také zaměřena na srovnání dané problematiky s evropskými státy s ohledem na možnou inspiraci pro právní úpravu a lidskoprávní diskuzi, která zde ohledně povinného očkování probíhá.The diploma thesis deals with human rights issues of mandatory childhood vaccination from the parents' perspective. The thesis is focused on the issue from the view of public health and the child's best interest. The paper deals with approaches of the European Court of Human rights, the Court of Justice of the European Union and the Constitutional Court of the Czech Republic. It particularly assesses the approach of the Constitutional Court and its conditions which was the court supposed to deal with in its rulings. The thesis further examines a question whether the interference from the mandatory childhood vaccination to parents' rights can be justified by the child's best interest principle. The thesis also compares the addressed issues of others European countries with respect to an inspiration for a Czech vaccination policy and human rights discussions.
