(143 892 znaků). -- Oponent Lenka Westphalová. -- Ved. práce Renáta Šínová. -- Abstract: Diplomová práce hovoří o právech putativního otce při určování a popírání otcovství v české právní úpravě. Jsou zde rozebírány, jaké možnosti putativní otec k ochraně svých práv a k následnému sladění biologického a právního otcovství má, a jaké nikoli. Cílem práce je zjistit, zda mají putativní otcové nějaká práva a možnosti, jak se bránit a domáhat svých práv a jestli jsou pro něj tato práva dostačující. Práce také analyzuje, zda je současná právní úprava putativních otců uspokojivá a zda je v souladu se závěry Evropského soudu pro lidská práva. Diplomová práce se skládá z pěti kapitol. V první definuji pojmy putativní otec a putativní otcovství, zaobírám se touto problematikou a také se zaměřuji na práva samotného dítěte a jejich ochranu. V následující kapitole se zabývám aktuálními otázkami putativního otcovství v souvislosti s určováním a popíráním otcovství. Oba instituty obecně analyzuji, v základech charakterizuji domněnky otcovství a zajímám se o problematiku vývoje vědy. Třetí kapitola hovoří o první domněnce, jejích specifických případech, konverzi první domněnky ve druhou a domněnce svědčící muži, který dal souhlas k umělému oplodnění, to vše se zaměřením na práva putativního otce. Na tuto kapitolu plynule navazuje čtvrtá, která se věnuje druhé domněnce otcovství, problematice souhlasného prohlášení a též právům putativních otců s tímto spojenými. Jako poslední je pátá kapitola, jež se zabývá třetí domněnkou a právy putativních otců při soudním rozhodnutí.. -- Abstract: The diploma thesis is dealing with the rights of a putative father in determining and denying paternity in the Czech law. Here are analyzed the possibilities of a putative father to protect his rights and the subsequent harmonization of biological and legal paternity. The aim of the thesis is to find out whether the putative fathers have any rights and possibilities to defend themselves and to enforce their rights and whether these rights are sufficient for them. The thesis also analyzes whether the current legislation of putative fathers´position is satisfactory and whether it is in an accordance with the conclusions of the European Court of Human Rights. The thesis consists of five chapters. In the first I define the terms putative father and putative fatherhood, I deal with this issue and also focus on the rights of the child and their protection. In the next chapter I deal with actual questions of putative paternity in connection with determining and denying paternity. I generally analyze both institutes, basically characterize the presumptions of paternity and I am interested in the issues of science development. The third chapter talks about the first presumption, its specific cases, the conversion of the first presumption into the second and presumption which belongs to a man who gave consent to artificial insemination, all focusing on the rights of the putative father. This chapter fluently crosses to fourth chapter, which deals with the second presumption of paternity, the declaration of consent problematics, and also the rights of the putative fathers connected with it. The last is the fifth chapter, which deals with the third presumption and rights of putative fathers in a court decision.
