(119 896 znaků) + CD ROM. -- Ved. práce Lenka Westphalová. -- Oponent Milana Hrušáková. -- Abstract: V diplomové práci na téma "Paternitní spory" se autorka věnuje problematice určování a popírání otcovství s důrazem na změny, kterých doznal právní řád v důsledku právní úpravy obsažené v zák. č. 89/2012 Sb., občanský zákoník a zák. č. 292/2013 Sb., o zvláštních řízeních soudních. Cílem práce je zodpovědět výzkumnou otázku, která zní: Je aktuální právní úprava určování a popírání otcovství již dostatečně efektivní a odpovídá evropským standardům, nebo se má ještě kam vyvíjet? Diplomová práce je rozdělena do pěti kapitol, které se dále člení na jednotlivé podkapitoly. V první kapitole je čtenář seznámen s obecnými základními pojmy, jako je dítě, matka, otec, rodičovství a evropské standardy. Druhá kapitola je věnována popisu koncepcí čtyř vyvratitelných právních domněnek, dle kterých právní řád ČR určuje otcovství muže k dítěti. Třetí kapitola se věnuje problematice popírání těchto domněnek a také kritizuje nezakotvení popěrného práva dítěte do právního řádu ČR. Obě tyto kapitoly obsahují také komparaci aktuální právní úpravy a předchozí právní úpravy a současně i zhodnocení těchto změn a věnuje se i úvahám de lege ferenda. Čtvrtá kapitola se věnuje procesním zvláštnostem, které vykazují paternitní spory v porovnání s klasickým sporným řízení. V páté kapitole je řešen vliv mezinárodních a lidsko právních úmluv a judikatury Evropského soudu pro lidská práva na právní řád ČR. Tyto tendence a vliv jsou následně demonstrovány na třech významných judikátech ESLP.. -- Abstract: This master thesis deals with the "Paternity disputes". The author of this paper focuses on the issue of filiation and denial of paternity with the emphasis on the recent changes of Civil Code (Act no. 89/2012 Coll.) and related Code of Special Civil Procedure (Act no. 292/2013 Coll.). The aim is to answer the following research question: Is the current legislation of filiation and denial of paternity sufficiently effective and complies with the European standards or is there still a room for improvement? The thesis is divided into five chapters which are further divided into subsections. First chapter introduces the general key words such as child, mother, father, parenthood and the European standards. The second chapter describes the concept of four rebuttable presumptions which determine paternity from the point of view of Czech law. The third chapter is about denying these assumptions and criticizing children's denial rights omitted by the Czech law. Both mentioned chapters also include a comparison between the current legislation and the previous legislation as well as an evaluation of these changes and last of all they focus on "lex ferenda". The fourth chapter is devoted to procedural peculiarities that show paternity disputes in comparison with conventional contentious jurisdiction. The fifth chapter deals with the impact of international and civil rights conventions and the practice of the European Court of Human Rights on the Czech law. These trends and impacts are demonstrated on three major cases solved by the European Court of Human Rights.
