    Aktuální otázky určování otcovství [rukopis] / Ivana Klírová. -- 2014. -- Ved. práce Lenka Westphalová. -- Oponent Ondřej Šmíd. -- Abstract: Diplomová práce na téma "Aktuální otázky určování otcovství" podrobně rozebírá problematiku určování, ale také popírání otcovství jakožto jeho neodmyslitelnou součást. Téma je velice aktuální s ohledem na významné změny, ke kterým v posledních letech došlo. Práce je vystavěna zejména na porovnání současné právní úpravy účinné od 1. ledna 2014 s tou, která jí bezprostředně předcházela. V první kapitole je nastíněn vývoj otcovství a role otce v rodině. Následné kapitoly, které tvoří jádro diplomové práce, podrobně rozebírají tři domněnky otcovství. Podle první domněnky je za otce považován manžel matky. Druhá domněnka svědčí muži, který učinil s matkou dítěte souhlasné prohlášení. Soulož s matkou dítěte v kritické době je třetí domněnkou, na základě které určí otcovství soud. Mezi aktuální otázky tohoto institutu patří zejména délka popěrné lhůty a možnosti při jejím promeškání, zájem dítěte, analýza DNA a umělé oplodnění. Závěr diplomové práce je věnován porovnání české a slovenské právní úpravy určování otcovství.. -- Abstract: The diploma thesis on the topic "Contemporary issues of Affiliation" examines in a great detail the matter of affiliation but also deals with the denial of paternity as the essential part of the topic. With regard to the significant changes that have occurred in recent years the theme is very relevant for present days. The work is built mainly on the comparison of the current legislation effective from the 1st January 2014 with the legislation that immediately preceded it. The first chapter outlines the evolution of fatherhood and the role of the father in the family. Subsequent chapters, that constitute the core of the thesis, very thoroughly analyze the three presumptions of the paternity. According to the first presumption the husband of the mother is considered to be the father of the child. The second presumption favours the man who has made an affirmative declaration with the mother of the child. Sexual intercourse within critical time period is the criterion for the third presumption and on its basis, the court shall determine paternity. Further current issues associated with this topic are the length of the period for denial and options when it is wasted, the child's interest, DNA analysis, and artificial insemination. The conclusion of the thesis is devoted to the comparison of Czech and Slovak legal regulation of affiliation.
