Ratifikace mezinárodních smluv [rukopis] / Lucia Bíla. -- 2015. -- Oponent Michal Bartoň. -- Ved. práce Jiří Jirásek. -- Abstract: Ratifikácia medzinárodných zmlúv je problematikou veľmi zaujímavou, avšak pomerne komplikovanou. Cieľom tejto diplomovej práce je predovšetkým definovať znaky medzinárodných zmlúv podľa Ústavy Českej republiky, opísať a rozobrať proces zjednávania medzinárodných zmlúv, ich parlamentné prejednávanie a vlastnú ratifikáciu. Diplomová práca sa ďalej taktiež venuje vyhlasovaniu medzinárodných zmlúv a prieskumu súladu medzinárodných zmlúv s ústavným poriadkom Českej republiky. Diplomová práca je rozdelená do siedmich kapitol. Kapitola prvá je úvodom diplomovej práce. Druhá kapitola sa zaoberá samotným pojmom medzinárodného práva, jeho pomeru k právu vnútroštátnemu a recepciou medzinárodných zmlúv. Tretia kapitola diplomovej práce rozoberá tzv. euronovelu Ústavy Českej republiky, ktorá zásadným spôsobom zmenila vzťah Českej republiky k medzinárodnému právu, hlavne zmluvnému. Štvrtá kapitola je venovaná procesu zjednávania medzinárodných zmlúv, ich parlamentnému prejednávaniu a ratifikácii. Piata kapitola diplomovej práce rozoberá viazanosť Českej republiky medzinárodnými zmluvami a ich vyhlasovanie. Preventívnej kontrole ústavnosti, teda prieskumu súladnosti medzinárodných zmlúv s ústavným poriadkom Českej republiky sa venuje kapitola šiesta. Siedma kapitola je kapitolou záverečnou.. -- Abstract: The ratification of the international treaties is very interesting issue but quite complicated. The aim of this diploma thesis is primarily to define the characters of the international treaties according to the Constitution of the Czech Republic, describe and analyze the process of negotiation of the international treaties, parliamentary discussing of the international treaties and the ratification of the international treaties. Diploma thesis pays attention to the promulgation of the international treaties and assessing the constitutionality of the international treaties before its ratification. The thesis is divided into seven chapters. The first chapter is an introduction of the diploma thesis. The second chapter deals with the term international law and its relationship to the national law and the reception of international treaties. The third chapter of the diploma thesis describes so called euro-amendment of the Constitution of the Czech Republic, which has fundamentally changed the relations between the Czech Republic and international law, especially contract law. The fourth chapter is devoted to the process of negotiation of the international treaties, their parliamentary discussing and the ratification of the international treaties. The fifth chapter of the diploma thesis discusses legally binding of the international treaties for the Czech Republic and the promulgation of the international treaties. The sixth chapter deals with assessing the constitutionality of the international treaties before its ratification. The seventh chapter is the final.
