Evropský zatýkací rozkaz [rukopis] / Barbora Fialová. -- 2011. -- Oponent Jiří Jelínek. -- Ved. práce Alexander Nett. -- Abstract: Tato diplomové práce se zabývá evropským zatýkacím rozkazem a je zaměřena především na právní úpravu v České republice. Na začátku jsou vymezeny pojmy extradice, evropský zatýkací rozkaz a jejich základní rozdíly. Stěžejní částí práce je Rámcové rozhodnutí Rady a řešení otázky, zda by nebyla vhodnější forma mezinárodní úmluvy, dále implementace evropského zatýkacího rozkazu v České republice a problémy s ní spojené a obecně přezkum ústavnosti implementovaných právních předpisů. V samotném závěru je uvedeno alespoň pár příkladů aplikace evropského zatýkacího rozkazu v praxi a některé úvahy de lege lata a de lege ferenda.. -- Abstract: This thesis deals with the European arrest warrant, which was defined in the Framework Decision of the Council. The work is focused on legislation in the Czech Republic. The beginning is devoted to defining the terms of extradition, the European arrest warrant and their fundamental differences. The main section is the Framework Decision and the associated question of whether it would be a better form of international conventions, as well as implementing the European Arrest Warrant in the Czech Republic and the problems associated with it, and generally review of the constitutionality of the legislation implemented. At the end there are a few examples of the application of the European arrest warrant in practice and some of the considerations de lege lata and de lege ferenda.
