RESUMÉ Tomáš Chlebek: FRANCOUZSKÁ REVOLUCE ? POLITICKÉ PROCESY První část práce je zaměřena na podobu, vývoj a změny trestního práva a trestního procesu ve Francii v 18. století, a to jak v průběhu desetiletí, která předcházela Revoluci, tak v prvních letech Revoluce. Jsou zde analyzovány nejvýznamnější právní dokumenty s nezměrným dopadem na oblast justice a trestní jurisdikce: Deklarace práv člověka a občana z roku 1789 a působivý Trestní zákoník z roku 1791; rovněž je zmíněna otázka trestu smrti v revoluční Francii. Druhá část je věnována ? v mnoha směrech netypickému ? politickému procesu s králem Ludvíkem XVI. a neoddělitelnému vývoji, jenž mu bezprostředně předcházel a který sleduje úpadek a pád krále na politické scéně znovuzrozené Francie od počátku Revoluce, definitivní kolaps jeho moci a svržení trůnu povstáním 10. srpna 1792. Poté, co byla založena republika, se sesazený král stal nepohodlnou a podezřelou osobností stojící mimo národ, o jejíž budoucnosti a dalším (ne-)bytí mělo být rozhodnuto ve ?spravedlivém? soudním procesu. Za účelem realizace spravedlnosti a vlády zákona se nové zákonodárné a rovněž exekutivní těleso, Národní konvent, stalo rovněž ad-hoc nejvyšším soudním orgánem reprezentujícím francouzský národ jako celek, oprávněným vést soudní řízení s Ludvíkem. V souvislosti s tím musely být zodpovězeny významné právní otázky ? kdo přesně a jak vlastně by měl být souzen zástupci národa. Klíčové parlamentní projevy vůdčích revolucionářů (Saint-Just, Robespierre, Condorcet, Danton) postupně ovlivnily většinu ve sněmovně a nasměrovaly průběh procesu k vyhlášení trestu smrti. Ve třetí části je vylíčeno nejen zrození, vývoj a fungování speciálního trestního soudu. Od jara 1793 tato nová instituce ? Revoluční tribunál ? byla jedním z klíčových nástrojů revoluční vlády a stala se symbolem revolučního teroru. Jakmile byla potlačena girondinská opozice, diktatura Paříže a jakobínů se stala zřejmou a politická represe běžnější a zhoubnější. Politické procesy s ?nepřáteli republiky? se staly zákonným způsobem jak je zničit, a to díky speciálním úpravám trestní procedury a procesních práv obviněných osob. Hlavní pozornost je věnována tragickému osudu Girondy, jež byla usmrcena znásilněním základních principů zastupitelské demokracie, soudnictví a lidských práv; ale rovněž další významné kauzy stejně jako související (proti-)právní akty jakobínské diktatury jsou zde rozebírány. Je zde rovněž uváděna základní statistika obětí období teroru. Činnost Revolučního tribunálu je pokryta jak v průběhu vlády teroru, tak po jejím pádu v létě 1794, až do jeho zrušení na jaře 1795.RESUMÉ Tomáš Chlebek: FRENCH REVOLUTION ? POLITICAL TRIALS The first part is focused on the form, evolution a changes of criminal law and criminal procedure in France in the 18th century, during the decades before the Revolution has come, and also in the first years of the Revolution in this work. The most important documents with the enormous impact on the area of justice and criminal jurisdiction are analyzed: Declaration of the Rights of Man and of the Citizen of 1789 and impressive Penal Code of 1791, as well as the questions of the death penalty in revolutionary France are mentioned. The second part is devoted to the, in many way untypical, political trial with the king Louis XVI and its necessary prelude, which subsumes his decline and fall on the political stage of newborn France since the beginning of Revolution and total collapse of his authority and overthrowing of throne through the insurrection of August 10, 1792. The Republic was founded and the king became unfavorable and suspicious personality out of the nation, whose future (no-)being should be determined in a ?fair? trial. In order to provide the justice and rule of law, the new legislative and also executive body, National Convention, became also the ad-hoc Supreme Court representing the whole French nation, authorized to conduct legal proceedings with Louis. The important legal questions had to be answered ? who exactly and how should be judged by representatives of the nation. The key speeches (Saint-Just, Robespierre, Condorcet, Danton) gradually influenced the majority in parliament and led the course of trial to pronounce the death penalty. In the third part, there is drawn not only the birth, evolution and function of the special criminal court and its victims. Since the spring 1793 this new institution, the Revolutionary Tribunal, was one of the main instruments of the revolutionary government and became a symbol of revolutionary Terror. With the elimination of the opposition, the Girondists, the dictatorship of Paris and Jacobins became evident and political repression more common and more ruinous. Political trials with the ?enemies of the Republic? became the legal method how to destroy them due to special corrections of a criminal procedure and rights of accused persons. Main attention is paid to the tragic fate of Gironda which was put to death by the violation of the basic principles of the representative democracy, justice and human rights; but also other significant causes as well as related (i-)legal acts of Jacobin dictature are analyzed. The basic statistics of the terrible period of Terror (1793-1794) is also presented there. The work of Revolutionary tribunal is covered during the reign of the Terror and even after its fall in the summer 1794, till its end in the spring 1795.
