Tématem této diplomové práce je Implementace whistleblowingu do českého právního řádu. Práce je strukturována do 4 kapitol. V první kapitole je věnována pozornost představení pojmu whistleblowing a whistleblower. S ohledem na přijetí směrnice Evropského parlamentu a Rady 2019/1937, o ochraně osob, které oznamují porušení práva unie a nutnost její implementace do právních řádů členských států práce, v kapitole druhé ukazuje, jakým způsobem vybrané státy k implementaci přistoupily a jaké lze mezi nimi nalézt rozdíly. V nejstěžejnější části se práce věnuje právní úpravě whistleblowingu v České republice. Představeny jsou návrhy zákonů připravované před i po přijetí unijní úpravy. Největší pozornost je pak věnována zhodnocení nejnovějších návrhů zákonů, které byly připravovány s cílem implementovat Směrnici do českého právního řádu. Poslední kapitola má za cíl poskytnout úvahu nad otázkou možného střetu ochrany oznamovatelů se zásadou loajality.This diploma thesis deals with Implementation of whistleblowing into the Czech legal system. The thesis is structured into 4 chapters. First chapter is dedicated to introduction of the concept of whistleblowing and whistleblower. Due to adoption of the Directive (EU) 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law and the necessity of its transposition into the legal systems of the member states of the European Union thesis, the second chapter shows how specific states have approached the implementation and what are the differences between them. In the main part the thesis deals with the legal regulation of whistleblowing in the Czech Republic. Bills prepared before and after the adoption of the EU regulation have been presented. The greatest attention is then devoted to the evaluation of the latest bills, which have been prepared with the aim of transposing the directive into the Czech legal system. The final chapter aims to provide a reflection on the possible conflict between whistleblower protection and the principle of loyalty.
