Diplomová práce se zaměřuje na sdílení autorských děl na sociálních sítích. V práci je vymezen pojmem sociálních sítí, také určení rozhodného práva a jurisdikce s ohledem na mezinárodní povahu sociálních sítí. Dále se zabývá tím, jaký obsah sdílený na sociálních sítích je hoden autorskoprávní ochrany dle zákona č. 121/2000 Sb. autorský zákon, také jak zde mohou být autorská díla užita. Následně je rozebrána odpovědnost uživatelů a poskytovatelů sociálních sítí za porušování autorského práva. V poslední části se práce zabývá dvěma články směrnice Evropského parlamentu a Rady 2019/790 o autorském právu a právech s ním souvisejících na jednotném digitálním trhu (čl. 15 a čl. 17), které ovlivňují fungování sociálních sítí a jsou nejvíce diskutovány s ohledem na jejich zavedení do praxe.The thesis focuses on the sharing of copyrighted works on social networks. The thesis defines the concept of social networks, also determining the applicable law and jurisdiction with regard to the international nature of social networks. It also addresses what content shared on social networks is worthy of copyright protection under the Copyright Act 121/2000 Coll., also how copyrighted works can be used there. Subsequently, the liability of users and providers of social networks for copyright infringement is analyzed. In the last part, the thesis discusses two articles of Directive (EU) 2019/790 of the European Parliament and of the Council on copyright and related rights in the Digital Single Market (Art. 15 and Art. 17), which affect functioning of social networks and are the most discussed with regard to their implementation in practice.
