(149 697 znaků). -- Ved. práce Bronislava Coufalová. -- Oponent Roman Vicherek. -- Abstract: Tato diplomová práce obsahuje mimo vymezení pojmů problematiku znaleckého dokazování v kontextu trestných činů v dopravě a možnosti řešení trestní věci formou podmíněného zastavení trestního stíhání. Část o znaleckých posudcích se zaměřuje na otázky, které jsou kladeny znalcům, zpracování znaleckých posudků a jejich obsah, to vše rozlišeno dle oborů a odvětví znalecké činnosti, s uvedením případných specifik znaleckých posudků, opět rozlišeno dle oborů a odvětví. Závěr části o znaleckých posudcích se věnuje jejich využití soudy, hodnocení jejich významu pro řízení a důkazní síly. Část týkající se procesního řešení se zabývá jednotlivými předpoklady pro užití podmíněného zastavení trestního stíhání z pohledu odborné literatury a rozhodovací praxe českých soudů, a dále pak hodnocením soudy co do naplnění jednotlivých předpokladů s pokusem o popis postupu soudu při tomto zkoumání a názory týkající se dostatečnosti odůvodnění naplnění předpokladů.. -- Abstract: This diploma thesis contains, besides the terms' definitions, the issue of experts' opinions proving in the context of traffic crimes and the possibility of solving these criminal cases in the form of a conditional suspension of criminal prosecution. The part containing from experts' opinions is focused on the questions that are asked to the experts, the processing of the experts' opinions and their content, everything this differentiated according to field and branch of the experts' activities, with presentation of possible specifics of experts' opinions also differentiated according to the field and branch of the experts' activities. The conclusion of part about experts' opinions deals with their application by the courts, evaluation of their relevance for the case and their weight. The part about the procedural solution deals with preconditions for using of conditional suspension of criminal prosecution individually from the point of view of expert literature and Czech courts' decisions, and then deals with evaluation about the fulfilment of individual preconditions by the courts with attempt for description of the court's evaluation and opinions about the sufficiency of substantiation about the fulfilment of those preconditions.
