Ve své diplomové práci analyzuji právní myšlení Gustava Radbrucha. V pozadí těchto analýz stojí dilema mezi pozitivismem a iusnaturalismem, které je prezentováno známou debatou H. L. A. Harta s L. L. Fullerem. Dále se zabývám proměnlivostí pojmu spravedlnost a odlišuji spravedlnost legální od etické. Zkoumám otázku Radbruchova poválečného "obratu" v jeho právním myšlení a analyzuji Radbruchovu formuli. Navazuji na otázku, zda jeho formule stojí v protikladu k právnímu pozitivismu. Předkládám soudní rozhodnutí, ve kterých byla formule použita a konečně uvádím argumenty, které formuli podrobují kritice.In my diploma thesis I analyze the legal thinking of Gustav Radbruch. The backround of these analyses is the dilemma between positivism and iusnaturalism, which is presented in the well- known debate of H. L. A. Hart and L. L. Fuller. Furthemore, I deal with the variability of the concept of justice and distinguish legal justice from ethical one. I examine the issue of Radbruch's post-war "turnaround" in his legal thinking and analyze Radbruch's formula. I follow up the question of whether his formula contradicts legal positivism. I present the judgments in which the formula was used, and finally I state arguments which criticize the formula.
