Diplomová práce se věnuje problematice zkušebního provozu stavby. Cílem práce je rozebrat smysl a účel tohoto institutu, vymezit jeho historický vývoj a zpracovat komparaci se slovenskou právní úpravou. Práce dále analyzuje aktuální judikaturu a odbornou literaturu s ohledem na základní kritéria rozhodnutí o zkušebním provozu, kterými jsou podmínky pro jeho vydání, stanovení délky zkušebního provozu a dalších relevantních parametrů. Jedním z hlavních bodů práce je pak shrnutí možných opravných prostředků proti rozhodnutí o zkušebním provozu, a to z hlediska účastníků řízení i dalších osob tímto rozhodnutím dotčených společně s analýzou okruhu účastníků řízení a dotčených osob. Z praktického hlediska je kladen důraz především na vyhledání a popis skutečných případů, ve kterých dochází ke zneužití institutu zkušebního provozu v rozporu s jeho smyslem a účelem.The diploma thesis deals with the problems of the building test operation. The aim of the thesis is to analyse the purpose of this institute, to define its historical development and to compare to the Slovak legal regulation. The thesis further analyses current case law and professional literature with regard to the basic parameters of the building test operation decisions, which are the conditions for its issuance, determination of the length of the test operation and other relevant parameters. One of the main points of the thesis is to summarize possible legal remedies against the building test operation decisions from the point of view of the parties to the proceedings and other persons influenced by such decision, together with an analysis of the parties to the proceedings and the influenced persons. From a practical point of view, the emphasis is mainly on finding and describing the real cases in which the building test operation institute is misused in violation of its purpose.
