Tato diplomová práce se zabývá přístupem Nejvyššího soudu ČR k aplikaci zásady subsidiarity trestní represe. Na úvod je teoreticky vysvětlena tato zásada a její vztah k ostatním důležitým zásadám trestního práva. Analýza vybraných judikátů Nejvyššího soudu České republiky je následována vlastními úvahami autora, jak by se mělo s touto základní zásadou trestního práva v praxi zacházet, tedy zda by se mělo příslušné ustanovení vykládat extenzivně či restriktivně. Opomenuty nejsou ani nálezy Ústavního soudu České republiky, které se zabývají touto zásadou, neboť tato zásada má mimo jiné i přesah do ústavního pořádku České republiky. Dále se autor zaměřuje na vybraná ustanovení trestního zákoníku, kde by bylo možné, a ve velkém množství případů i vhodné, tuto zásadu aplikovat, případně na ustanovení, která by se měla zrušit. V neposlední řadě následuje srovnání se zahraniční právní úpravou, konkrétně německou a rakouskou.This Master's degree thesis deals with access of the Supreme Court of the Czech Republic to principle of subsidiarity of criminal repression. At the beginning of this thesis, this principle is explained theoretically and also its link to the other important principles of the criminal law is introduced. The analysis of selected jurisprudence of the Supreme Court of the Czech Republic is followed by the author's own considerations as to how this principle of criminal law should be dealt with in practice, whether this principle should be interpreted extensively or restrictively. Also some findings of the Constitutional Court of the Czech Republic are mentioned, because the principle of subsidiarity of criminal repression overlaps with the constitutional order of the Czech Republic, too. Furthermore, the author focuses on the selected provisions of the Penal Code, where it would be possible and appropriate (in many cases) to apply this principle, or to provisions that should be abolished, according to the author. Last but not least, there is a comparison with foreign legislation, namely German and Austrian.
