Tato diplomová práce se zaměřuje na problematiku rozsahu při určování výše výživného k nezletilým dětem a metodami používanými při stanovování výše výživného. První část (v 2. kapitole) je věnována historii úpravy rozsahu vyživovací povinnosti. Hlavní část práce (kapitola 3.) je zaměřena na aktuální právní úpravu tohoto institutu s analýzou kritérií rozsahu vyživovací povinnosti k nezletilým dětem. Vyživovací povinnost je upravena ve čtvrtém pododdílu oddílu třetího hlavy druhé a části druhé OZ, konkrétně pak v paragrafech 910 až 923. V této kapitole jsou podrobněji rozebrána kritéria rozsahu vyživovací povinnosti na straně povinného i oprávněného spolu s nejčastější problematikou, která s daným bodem souvisí. Čtvrtá kapitola se dále věnuje otázce metod užívaných při stanovování výše výživného jak u nás, tak i v zahraničních úpravách hlavně vzhledem k objektivizaci výše výživného. Následuje kratší kapitola zabývající se výživným ve střídavé péči a poslední kapitolou je věnována procesní úpravě řízení ve věci výživného.This diploma thesis focuses on the issue of the scope in determining the amount of maintenance to the minors and the formulas used in calculating the amount of child support maintenance. The first part (in Chapter 2) deals with the historical process of the legislation. The main part (chapter 3) focuses on the present legal regulation of this institute with the analysis of the scope of the maintenance. Maintenance obligation is enshrined in the fourth subdivision of the third section of the second part of Civil Code, specifically in paragraphs 910 to 923. There are analysed in more detail criterions of the scope of the maintenance obligations of the non-residental parent as obliged person on the first part and qualifying child as authorized on the second part, in this chapter with analysing the most common issues that relate to a given point. The fourth chapter is devoted to the issue of formulas used for calculating the amount of child support maintenance with comparison of our system with some used in foreign legislations given to the issue of the objectification of the rate of child support maintenance. At the end there is short chapter dealing with the rate of maintanance in the situation of alternating care, and the one devoted to procedural regulation of proceedings related to maintenance.
