Tato diplomová práce se zabývá tématem Právo shromažďovací v judikatuře českých soudů. Je rozdělena do osmi kapitol. První kapitola se věnuje právním pramenům shromažďovacího práva, druhá potom vykládá pojem "shromáždění" a termíny související. Třetí až sedmá kapitola se zabývají postupně jednotlivými instituty shromažďovacího práva. Třetí vysvětluje oznámení a oznamovací princip, čtvrtá se věnuje typům shromáždění, pátá rozebírá účel shromáždění a problematiku účelu fiktivního, šestá se věnuje místu a času shromáždění a limitům v této oblasti a sedmá kapitola přibližuje jednotlivé subjekty shromažďovacího práva svolavatele, správní orgán a účastníka a jejich práva a povinnosti. Stěžejní částí práce je kapitola osmá, pojednávající o omezení práva shromažďovacího, nejprve v rovině obecné a poté jednotlivě o zákazu a rozpuštění shromáždění. Rozebrány jsou důvody, postup úřadu, problematické aspekty, soudní ochrana Závěr potom obsahuje shrnutí a zhodnocení dané problematiky. Současnou právní úpravu hodnotím jako poměrně kvalitní, ale zákon o právu shromažďovacím obsahuje několik sporných míst, které by měly být novelou vyjasněny. Zatím jsou vykládána soudy v rámci jejich rozhodovací činnosti a vzhledem k tomu, že judikatura nemá normativní charakter, předestřená řešení i argumenty mají jen povahu doporučení. Domnívám se, že úprava zákonem by přispěla posílení právní jistoty.This diploma thesis deals with the topic of Freedom of Assembly in Decision-making of Czech Courts. It is divided into eight chapters. The first chapter deals with legal sources, the second defines the term "assembly" and some related terms. In the chapters three to seven I explain particular institutes of the right of assembly. The third chapter explains the announcement and the announcement principle, the fourth describes particular types of an assembly, the fifth deals with the purpose and the issue of a fictitious purpose, the sixth deals with time and venue of an assembly and limits of them and the seventh chapter describes particular subjects convener, administrative authority and participant and their rights and duties. The most important part of this thesis is the eighth chapter, dealing with limitations of the right of assembly, first in general and then individually with ban and dissolution of an assembly. Reasons, actions of the administrative authority, problematic aspects, and judicial protection are explained in this chapter. The conclusion summarizes and evaluates the whole topic. I consider the current legislation to be of quite high quality, but the Law on Freedom of Assembly contains a few questionable articles, which should be clarified by an amendment of the Law. So far they are interpreted by courts within their decision-making authority, but considering that judicature is not legally binding, solutions and arguments suggested by courts are just recommendations. I think that regulation by law would increase legal certainity.
