Závaznost rozhodování Ústavního soudu ČR [rukopis] / Miroslav Píštěk. -- 2011. -- Ved. práce Michal Bartoň. -- Oponent Jaroslav Sovinský. -- Abstract: Tato diplomová práce je zaměřena na výklad čl. 89 odst. 2 Ústavy České republiky, který stanoví, že "vykonatelná rozhodnutí Ústavního soudu jsou závazná pro všechny orgány a osoby". Cílem této práce je, v první části, zhodnocení problematiky závaznosti rozhodnutí Ústavního soudu ve vztahu k typům rozhodnutí Ústavního soudu, k jednotlivým částem rozhodnutí, a to výroku a odůvodnění, k druhům řízení před Ústavním soudem a k typům závaznosti. Druhou podstatnou částí je zhodnocení vztahu jednotlivých složek veřejné moci, zejména Parlamentu ČR, Nejvyššího soudu ČR a Nejvyššího správního soudu ČR, a Ústavního soudu v návaznosti na problematiku kasační a precedenční závaznosti rozhodnutí Ústavního soudu.. -- Abstract: This thesis focuses on the interpretation of Article 89, paragraph 2 of the Constitution of the Czech Republic, which stipulates that "the enforced decisions of the Constitutional Court are binding on all authorities and persons". The aim of the first significant part of this thesis is to evaluate the issue of the binding force of decisions of the Constitutional Court in relation to the types of decisions of the Constitutional Court, the various parts of the decision, especially the verdict and the ratio decidendi, the types of proceedings before the Constitutional Court and the types of binding forces. The second significant part is focused on the evaluation of the relationship of the various public authorities, especially the Parliament, the Supreme Court and the Supreme administrative court, and the Constitutional Court in relation to the issue of the cassation and precedent binding force of decisions of the Constitutional Court.
