V úvodních kapitolách je obecně popsána povaha exekučního řízení a zásady projevující se v tomto řízení se zaměřením na zásady ochrany a obrany povinného. Následně jsou vymezena jednotlivá hlediska záruky ochrany povinného a jejich projevy v současné právní úpravě a uplatnění při provádění výkonu rozhodnutí. V další části jsou prvně rozebírány instituty obrany povinného a následně instituty sloužící obraně třetích osob při výkonu rozhodnutí. Práce je zaměřena především na zhodnocení, zda právní úprava poskytuje dostatečnou ochranu právům povinného a třetích osob při výkonu rozhodnutí a zda instituty sloužící k obraně těchto subjektů jsou dostatečně efektivní.. -- Abstract: This diploma thesis deals with the protection and defence of an obligor and third parties in executory proceedings. Initial chapters generally describe the characteristics of the executory proceedings and the principles manifested in these proceedings, with the focus on the principles of protection and defence of an obligor. Consequently, individual views of obligor's guarantee are defined as well as their forms in the current legislation and their application in the implementation of decision enforcement. Another part deals with the provisions for obligor's defence at first, and then the provisions serving for the defence of third parties at decision enforcement. The thesis particularly focuses in the evaluation of the fact whether the legislation provides sufficient protection to the rights of the obligor and third parties in the enforcement of a decision and whether the provisions serving for the defence of such entities are sufficiently efficient.
