Alternativy nepodmíněného trestu odnětí svobody [rukopis] / Pavel Vrána. -- 2010. -- Ved. práce Filip Ščerba. -- Abstract: Cílem práce je analýza současné právní úpravy alternativních trestů nepodmíněného trestu odnětí svobody. Je přitom zaměřena zejména na nově zavedené tresty domácího vězení a zákazu vstupu na sportovní, kulturní a jiné společenské akce. Dalšími rozebíranými alternativními tresty jsou obecně prospěšné práce a peněžitý trest. V úvodních kapitolách je pro pochopení tematiky alternativního trestání nastíněn pojem a účel trestu, který je doplněn trestními teoriemi, přiblížena definice alternativního trestu a restorativní justice, ze které alternativní trestání vychází. Současně jsou i nastíněny rozdíly úprav dle někdejšího a současného trestního zákona. Nedílnou součástí práce jsou grafy, tabulky a textové dokumenty.. -- Abstract: Target of my work is to analyze contemporary legal adjustments of Alternativs to Unnconditional Sentence of Imprisonment. It is primarily aimed at newly established punishments of house arrest and bans on entering to sporting, cultural and other social events. Other analysed alternative punishments are community service and fine. For better understanding of the theme of alternative punishments is in the introductory chapters outlined the concept and purpose of punishment. It is supplemented by criminal theories and there is also a definition of alternative punishments and restorative justice on which alternative punishments are based. I also try to draw out differences between former and contemporary criminal code. Integral part of my diploma work are graphs, charts and text documents.
