(104 238). -- Oponent Lucia Madleňáková. -- Ved. práce Zdeněk Kopečný. -- Abstract: Předmětem této diplomové práce je rozbor vztahu advokáta a klienta se zaměřením na limity závaznosti pokynů klienta advokátovi. Cílem této práce je analýza ustanovení právních norem týkajících se profesní etiky advokáta, jeho povinností ve vztahu ke klientovi, odpovědnosti a určení limitů závaznosti pokynů klienta. Práce je členěna do šesti kapitol. V první kapitole jsou obecně popsány pojmy etika a morálka. Druhá kapitola se věnuje konkrétněji profesní etice advokáta a jejím pramenům. Třetí kapitola podrobněji popisuje vztah advokáta a klienta - jeho vznik, zánik a vzájemná práva a povinnosti. Čtvrtá kapitola se týká pokynů klienta advokátovi - vymezení pojmu a zakotvení v právních předpisech. Pátá kapitola pak vymezuje konkrétní hranice závaznosti pokynů klienta advokátovi skrze trojí odpovědnost advokáta a poslední šestá kapitola se věnuje zodpovězení samotné výzkumné otázky a to, zda trestný čin maření spravedlnosti zúžil hranice závaznosti pokynů klienta advokátovi.. -- Abstract: The subject of this master's thesis is an analysis of the relationship between a lawyer and a client with a focus on the limits of the binding effects of the client's instructions to the lawyer. The aim of this thesis is to analyse the provisions of legal norms concerning the professional ethics of a lawyer, his duties in relation to the client, liability and determination of the limits of the binding effects of the client's instructions. The thesis is divided into six chapters. In the first chapter, the concepts of ethics and morality are generally discussed. The second chapter deals more specifically with the professional ethics of a lawyer and its sources. The third chapter describes in more detail the relationship between a lawyer and a client - its origin, termination and mutual rights and obligations. The fourth chapter deals with the client's instructions to the lawyer - the definition and it´s codification in law. The fifth chapter then discusses the specific limits of the binding nature of the client's instructions to the lawyer through the triple responsibility of the lawyer and the last sixth chapter deals with answering the research question itself: whether the Crime of Obstruction of Justice narrowed the limits of the client's instructions to the lawyer.
