(142 921). -- Ved. práce Petr Dostalík. -- Oponent Ondřej Horák. -- Abstract: Tato diplomová práce se věnuje dvěma institutům soukromého práva - promlčení a vydržení v římském právu. Práce obsahuje úvod, dvě kapitoly a závěr. První kapitola se zaměřuje na promlčení v římském právu, druhá kapitola zkoumá vydržení v právu římském. První kapitola se nejprve zaměřuje na objekt promlčení, dále se zabývá promlčecí lhůtou a poté zkoumá následky promlčení v římském právu. Druhá kapitola se věnuje předpokladům vydržení s tím, že v první řadě uvádí, které osoby mohly v Římě vydržet a které věci mohly být předmětem vydržení. Následně se zabývá pojetím držby v římském právu, včetně okamžiků jejího nabytí a pozbytí. Dále posuzuje vztah vydržení a dobré víry, vymezuje požadavek spravedlivého důvodu a rozebírá následky vydržení ve starověkém Římě. Na závěr se zabývá délkou vydržecí lhůty v římském právu.. -- Abstract: This master's thesis focuses on two institutes of private law - lapse and prescription in Roman law. The thesis contains the introduction, two chapters and the conclusion. The first chapter is devoted to the lapse in Roman law, the second chapter looks into the prescription in Roman law. The first chapter in the first place focuses on the object of the lapse, then it deals with the period of limitation and after there it analysis the consequences of the lapse in Roman law. The second chapter is devoted to the prerequisites of the prescription with this that in the first place it defines which persons could be the subject of the prescription in Rome and which things could be the object of the prescription in Roman law. After there it deals with the conception of the possession, including the moments of the acquisition and the loss of the possession. Then it compares the relationship of the prescription and the good faith, it focuses on the requirement of the just cause and it analysis the consequences of the prescription in ancient Rome. Finally it defines the length of the period of prescription.
