Diplomová práce se zabývá problematikou vlivu pravidel hry na občanskoprávní odpovědnost sportovce za škodu na zdraví. Úvod práce je věnován základním pojmům a především právní úpravě odpovědnosti za škodu s přihlédnutím k sportovním specifikům. Autor určuje klíčové ustanovení občanského zákoníku, které se pro určení odpovědnosti použijí, a taktéž porovnává účinnou právní úpravu s občanským zákoníkem z roku 1964 z důvodu použitelnosti starší judikatury. Podstatnou část práce tvoří rozbor nejdůležitějších sportovněprávních teorií, které se zabývají vyloučením odpovědnost sportovce za škodu na zdraví. Autor věnuje zvýšenou pozornost ekonomické analýze práva a jejímu použití na sportovní případy. Závěrečná část práce je věnována judikatuře českých soudů a zahraničnímu přístupu k této problematice (Německo a Velka Británie). Na základě analýzy judikatury, literatury a právní úpravy u nás i v zahraničí vyslovuje autor názor, že pravidla hry mají stále značný význam pro určení odpovědnosti za škodu, ale nejsou jediným kritériem. Soudní praxe by měla zohledňovat i další elementy, které mohou mít za vliv omezení či vyloučení odpovědnosti za škodu.This thesis is focused on the influence of sports rules on the civil liability of athletes for sports injuries. In the first part of the thesis, the author briefly defines the basic terms and the important part is dedicated to the legislation in the area of civil liability for damages with respect to sports. The author determines the relevant articles of civil code which will be used in sports-related cases and also compares the effective legislation with the civil code from 1964, because of the possible usability of older judgments. The substantial part of the thesis contains the analysis of the most significant sports-law-related theories about the exclusion of civil liability of athletes for damages. The author focused mainly on the economic analysis of law and its importance for the liability of athletes for injuries. The last part is about the Czech case law and the foreign approach to this problematic (Germany and the United Kingdom). On the basis of the analysis of the Czech and foreign case law, the relevant literature and the legislation, the author expresses an opinion that the sport's rules have still an important influence on the determination of the civil liability for sports injuries, but they are not the only criterion. The courts should also take into account the other elements that could have an impact on the limitation or exclusion of the civil liability for damage.
