Peněžitý trest [rukopis] / Anna Kolmanová. -- 2015. -- 61 s. -- Ved. práce Filip Ščerba. -- Oponent Alexander Nett. -- Abstract: Tato diplomová práce pojednává o institutu peněžitého trestu, jako jedné z alternativ nepodmíněného trestu odnětí svobody. V rámci první kapitoly je peněžitý trest zařazen v systému alternativních opatření. Stěžejní a kvantitativně nejrozsáhlejší kapitola obsahuje komplexní hmotněprávní i procesněprávní úpravu peněžitého trestu dle účinné právní úpravy, dále komparaci s předchozí právní úpravou a zhodnocení dílčích novelizací. Třetí kapitola se zabývá srovnáním české právní úpravy peněžitého trestu s právní úpravou existující ve Slovenské republice. Následuje statistické zpracování ukládání peněžitého trestu v České republice, dále ukládání peněžitého trestu v souvislosti s majetkovou trestnou činností a ukládání peněžitého trestu v okrese Olomouc. Na závěr poslední, pátá kapitola rozebírá konkrétní rozhodnutí Okresního soudu v Olomouci, v souvislosti s majetkovou trestnou činností, s cílem zhodnotit opodstatněnost uložené sankce.. -- Abstract: The diploma thesis deals with the issue of institute of financial penalty as one of the alternatives to unconditional sentence of imprisonment. In the first chapter, financial penalty is defined in the system of alternative measures. The second chapter that is fundamental and quantitatively longest one, contains complex substantive and procedural aspects of financial penalty under the applicable legislation as well as a comparison with the previous legislation and evaluation of partial amendments. The third chapter compares the Czech financial penalty legislation with the existing legislation of the Slovak Republic. In addition, the thesis focuses on statistical data about the imposition of financial penalty in the Czech Republic, and furthermore, impositions of financial penalty linked to the crimes against property, and lastly, imposition of financial penalty in the Olomouc district. Finally, the fifth chapter analyses the specific decisions of the District Court in Olomouc linked to the crimes against property with aim to evaluate the merits of the sanctions imposed.
