Specifická úprava trestání mladistvých za správní delikty [rukopis] / Dita Viková. -- 2013. -- Oponent Kateřina Frumarová. -- Ved. práce Lucia Madleňáková. -- Abstract: Cílem práce na téma "Specifická úprava trestání mladistvých za správní delikty" je zhodnocení současného stavu právní úpravy, která se zabývá možnostmi trestání mladistvých pachatelů za jimi spáchané správní delikty. Jednotlivá specifika jsou porovnávána s úpravou v trestním právu. Práce je rozdělena do pěti kapitol. První kapitola je zaměřena na výklad obecných pojmů souvisejících s problematikou správního trestání a užitím analogie ve správním právu. Druhá kapitola je věnována osobě mladistvého a jeho správněprávní odpovědnosti. Stěžejní prací jsou kapitoly věnované hmotně právní a procesní úpravě, které analyzují jednotlivá ustanovení zákona č. 200/1990 Sb., o přestupcích, která jsou zaměřena na správní trestání mladistvých. V poslední části práce jsou pak identifikovány základní problémy a nedostatky stávající právní úpravy. Současně jsou zde také uvedeny návrhy možných řešení.. -- Abstract: The aim of this diploma thesis called "Special legal enactment of punishing teenagers for administrative offences" is to assess current state of legislation that deals with possibilities of punishing teenagers for administrative offences committed by them. Particular specifics are compared to current criminal legislation. The thesis is divided into five chapters. The first one is focused on the interpretation of general concepts related to the issue of administrative punishment and the use of analogies in administrative law. Second chapter deals with teenager's personality and his administrative liability. The key parts of this thesis are chapters aimed to substantive and procedural rules. There are analyzed particular provisions of the Act No. 200/1990 Coll. that are focused on teenagers and its administrative punishing. In the last chapter are identified the basic problems and imperfections of current legislation. At the same time there are also given possible solutions for those problems.
