Tato práce se věnuje vztahu mezi univerzalismem a pozitivním právem. Autor si pokládá otázku, zda existují nějaké pozitivněprávní entity, které jsou univerzální. Univerzalita je totiž obvykle spojovaná zejména s přirozeným právem, často se také zmiňuje v souvislosti s lidskými právy. Autor této práce ovšem uzavírá, že lidská práva nemůžeme pojímat jako pozitivní právo. A základní práva, která jsou sice pozitivněprávním zakotvením práv lidských, zase nemůžeme považovat za univerzální. A to ani kdyby na konkrétní pozitivněprávní úpravě byl celosvětový konsenzus, protože požadavek univerzality ve smyslu lidských práv má i působnost časovou, která by ani v případě momentálního konsenzu nemohla být naplněna. Na druhou stranu autor představuje jiné entity pozitivního práva, které aspirují na univerzalitu. Jsou to právní principy. Ne každý právní princip má univerzální působnost. Zejména u odvětvových zásad se o univerzalitě bavit nemůžeme. Zároveň ovšem existují i právní principy, které jsou součástí každého právního řádu. Takovým principem je např. princip, že neznalost zákona neomlouvá (ignorantia iuris non excusat) či že pozdější předpis ruší dřívější (lex posterior derogat legi priori). Právě u těchto principů lze hovořit o jejich univerzalitě, protože jsou součástí každého právního řádu.This thesis addresses the relation between universalism and positive law. The author poses a question if there are some entities of positive law, which are also universal. Universality is usually associated with natural law, it is often mentioned in the context of human rights. The author, however, concludes, that human rights cannot be understood as a positive law. And as for fundamental rights, which are a transformation of human rights into positive law, those are not universal. Even if there was a worldwide consensus on the specific positive law. That is because the requirement of universality is also the temporal scope, which is not met even in case of consensus because the next day the consensus might not be there. On the other hand, the author presents other entities of positive law, which aspire to universality legal principles. Not every legal principle has universal scope. Especially in case of principles of particular legal fields we cannot conclude that they are universal. But alongside, there are also legal principles, that are part of every legal order. It is e.g. the principle that ignorance of the law excuses no one (ignorantia iuris non excusat) and the principle that a later law repeals an earlier (lex posterior derogat legi priori). As for principles like these we can conclude their universality as they are present in every legal order.
