Tato diplomová práce je zaměřena na jeden z nejvýznamnějších rozhodovacích orgánů v rámci sportovních organizací v České republice, a to na rozhodčí komisi spolku. Tento orgán rozhoduje o sporných otázkách, které spadají do spolkové samosprávy. Rozhodnutí tohoto fakultativního orgánu spolku nabyla na významu novou úpravou obsaženou v NOZ. Tyto rozhodnutí mají nyní povahu exekučních titulů. V práci je podrobně rozebráno postavení a fungování rozhodčí komise a problematika přezkumu rozhodnutí této komise. Práce bere v potaz i situaci, kdy sportovní organizace nemá zřízenou rozhodčí komisi či sama rozhodčí komise rozhoduje o některých sporných otázkách (vyloučení člena) a uvádí prostředky ochrany proti těmto rozhodnutím. Hlavním cílem této diplomové práce bylo nastínění teoretického základu fungování rozhodčí komise spolku v české právní úpravě a zodpovězení otázky, zda zavedení rozhodčí komise spolku vedlo k vetší nezávislosti sportovních organizací. V práci byla provedena kompletní analýza právní úpravy vztahující se k rozhodčí komisi. Byl uveden účel, význam, hodnota, postavení a fungování rozhodčí komise spolku v České republice. Z nastínění teoretického základu fungování rozhodčí komise spolku v české právní úpravě byla vyhodnocena základní otázka, jaké předpoklady musí splnit daná sportovní organice, aby mohla zřídit rozhodčí komisi a zároveň aby byla její činnost dostatečně efektivní a nezávislá. V průběhu práce došlo i k zamyšlení nad možným teoretickým řešením problematických otázek a doporučeními de lege ferenda.This diploma thesis is focused on one of the most important decision-making bodies within sports organizations in the Czech Republic, namely the arbitration committee of the association. That body decides on the issues which fall within the federal self-government. The decisions of this facultative body of the association became more and more important by the new regulation contained in the NCC. These decisions are now enforceable titles. The work analyzes in detail the position and functioning of the arbitration commission and the issue of reviewing decisions of this commission. The work also takes into account the situation when the sports organization does not have an arbitration commission or the arbitration commission itself decides on some controversial issues (exclusion of a member) and indicates the means of protection against these decisions. The main aim of the work was to describe whether the establishment of the arbitration committee of the association will increases the independence of the sports organization. The work contains a complete analysis of the legislation relating to the arbitration panel. The purpose, meaning, value, position and functioning of the association's arbitration committee in the Czech Republic were stated clarified. From presenting the theoretical basis of the functioning of the association arbitration commission in the Czech legislation was evaluated the basic question, what precondition must fulfil the given sports organization, to be able to establish the arbitration commission and at the same time to be sufficiently effective and independent. In the course of the work, the possible theoretical solution of problematic questions and recommendations de lege ferenda were also considered.
