Diplomová práce je zaměřena na vývoj "petitorní" ochrany obligačních užívacích práv proti zásahům třetích osob na našem území od všeobecného zákoníku občanského do současnosti (geneze ustanovení § 1044 a § 2211 OZ). Stranou byla nechána otázka držby a posesorní ochrany. První kapitola nazvaná jako "Východiska" slouží jako úvod do problematiky, který vymezuje podstatu rozdílu mezi obligačními právy jako relativními majetkovými právy a věcnými právy jako absolutními majetkovými právy a podstatu ustanovení na ochranu obligačně oprávněného detentora proti třetím osobám, jejichž vývoj je tématem práce. Následující kapitoly se poté věnují předmětné problematice v jednotlivých historických obdobích (obecný zákoník občanský, meziválečná rekodifikace, socialistické právo, současné právo). Za použití obecných vědeckých metod, metod historického výzkumu a metod sloužících k nalézání práva práce vystihuje vývoj dané problematiky ve zkoumaných historických obdobích. Pomocí metod sloužících k nalézání práva (výkladových metod, teleologické redukce, analogie) je poté interpretována také současná právní úprava, na kterou je nazíráno nejen z pohledu historických souvislostí, což je hlavním účelem této práce, ale také prostřednictvím zejména teleologických argumentů.Master's thesis is devoted to development of the "petitor" protection of obligational rights to use against third parties from Austrian civil code (Allgemeines bürgeliches Gesetzbuch from 1811, ABGB) to the present (the genesis of § 1044 and § 2211 OZ). The thesis skips the issues of the possession and the protection of possession. The first chapter is called "Basis" and it serves as an introduction to the issues that are the topic of the thesis. The first chapter defines the principle of differentiation between the obligational and the real rights and also the substance of the legislation that provides the protection to obligational rights of detentor against third parties. Following chapters deal with the issue in the context of the selected historical periods (ABGB, the interwar recodification, socialist law, current law). By using the general scientific methods, methods of historical research and special methods for finding the law the thesis characterizes the development of the determined issue during the selected historical periods. By using the special methods for finding law (interpretation of law, teleological reduction, analogy) is also interprets the current legal regulation that is viewed not only from the historical point of view, which is the main purpose of this work, but also through the teleological arguments.
