Předmětem práce je detailní rozbor institutu rekonstrukce trestného činu, která se řadí mezi zvláštní důkazní prostředky, které jsou upraveny v páté hlavě v oddíle třetím trestního řádu pod názvem "Některé zvláštní způsoby dokazování", mezi které se řadí konfrontace, rekognice, vyšetřovací pokus, rekonstrukce a prověrka na místě. Tyto prostředky specifickým způsobem zjišťují a dokumentují skutečnosti, které jsou významné v trestním řízení a obstarávají tak důkazy v konkrétní trestní věci. Jednotlivé zvláštní důkazní prostředky vykazují specifické znaky, kterými se od sebe odlišují, a neměly by se zaměňovat. V práci je vymezena zejména odlišnost vůči vyšetřovacímu pokusu a prověrce na místě. Hlavním cílem práce je rozbor pojmu a podstaty rekonstrukce trestného činu z hlediska trestněprávního a z hlediska kriminalistického, historický vývoj tohoto institutu před zakotvením v trestním řádu a její úprava de lege lata, kdy výsledkem práce jsou úvahy de lege ferenda. Cílem práce je také představit funkce rekonstrukce, jednotlivé subjekty účastnící se rekonstrukce, základní taktické a metodické doporučení pro přípravu rekonstrukce a jejího průběhu a vymezení jednotlivých stádii průběhu rekonstrukce. V práci není opomenuta dokumentace rekonstrukce, její protokolace a i jiné formy dokumentace a následné hodnocení. V neposlední řadě je v práci nastíněna i úprava v zahraničí a její srovnání s českou trestní úpravou.The subject of my thesis is a detailed analysis of a crime reconstruction. The reconstructions of crimes belong to special means of proofs, which are regulated in the Criminal Procedure Code entitled "The special means of proofing", which includes the confrontation, the reconnaissance, the investigative trial, the reconstruction of a crime and the place review. The special means of proofing serve to identifying and documenting things, which are important in the criminal proceedings, and they also provide evidence in specific criminal cases. Each mean of proofing has its special characteristics. The means differ from one another and should not be confused. The thesis mainly showed the difference between the reconstruction of a crime and the investigative experiment. The main aim of this thesis was to analyse the concept and the essence of the reconstruction of a crime from the criminal and the criminalistics perspective, and to show the historical development of the reconstruction of a crime before it was established in the Criminal Procedure Code. The thesis also showed the functions of the reconstruction of a crime. It also showed the individual subjects involved in the reconstruction, basic tactical and methodical recommendations for the preparation and the process of the reconstruction of a crime, and the individual stages of the process of the reconstruction. The thesis showed the documentation of the reconstruction, the protocol and other forms of the documentation, and the subsequent evaluation of the reconstruction. At the end of the thesis, there is an outline of the reconstruction of a crime abroad and its comparison to the Czech reconstruction of a crime.
