Diplomová práce pojednává o institutu výměnku. Cílem práce je seznámit čtenáře s historickým vývojem výměnku, objasnit pojem výměnku, vysvětlit jeho právní povahu a propojit ustanovení o výměnku se souvisejícími ustanoveními účinné úpravy. Při zkoumání tohoto institutu jsem se zaměřila na odhalení problematických situací a nalezení jejich řešení. Vzhledem k tomu, že česká úprava zařadila výměnek zpět do legislativy po čtyřiceti osmi letech, během nichž výměnek nebyl užíván, právní praxe bude mít nejspíš potíže s jeho znovuuvedením do života. Srovnala jsem proto úpravu výměnku v českém právu s úpravou polskou, neboť ta výměnek užívá v praxi kontinuálně už desítky let. Práce nemá za úkol vyčerpat veškeré právní aspekty výměnku, ale především představit a charakterizovat výměnek, ukázat, jakým způsobem jej lze sjednat či naopak zrušit.The thesis deals with the institute of reserved rights of enjoyment. The aim is to acquaint the reader with the historical development of the reserved rights of enjoyment, to clarify the concept of the reserved rights of enjoyment, explain its legal status and connect the provisions of the reserved rights of enjoyment with the relevant provisions of the effective adjustment. In examining this institute, I focused on the detection of problematic situations and finding their solutions. Due to the fact that the Czech adjustment included the reserved rights of enjoyment back into the legislation after forty-eight years, during which the reserved rights of enjoyment have not been used, the legal practice will probably have trouble with their putting back into the life. I compared the adjustment of the reserved rights of enjoyment in the Czech law with the adjustment of the Polish one, because this institute has been used in practice continuously for decades there. This work is not a task to exhaust all the legal aspects of the reserved rights of enjoyment, but mainly to present and characterize the reserved rights of enjoyment and show the way in which it can be arranged, or vice versa, to canceled.
