Diplomová práce se zabývá problematiku náhradního mateřství. Cílem této práce bylo zhodnotit zejména právní situaci v dnešní době velmi kontroverzního tématu, které se v České republice a obecně ve světě dostává do stále většího povědomí. V první části jsou vymezeny pojmy nepostradatelné pro proniknutí do tématu, zanalyzovaná právní úprava České republiky a jsou nastíněny problematické situace týkající se institutu náhradního mateřství. V další části je rozebrána vybraná judikatura jak Evropského soudu pro lidská práva, tak vnitrostátních soudů, jako též zahraniční právní úprava jednotlivých států, která se prolíná s poslední částí práce. Ta nastiňuje možnou podobu nové legislativy na našem území potřebnou z důvodu nedostatečné, téměř nulové právní úpravy, a to s inspirací právě v právních řádech jiných států světa.The thesis deals with the issue of surrogacy. The aim of this thesis is to evaluate the legal situation in today's very controversial topic, which is gaining more and more awareness in the Czech Republic and in the world in general. The first part defines the concepts indispensable for penetrating the topic, the analysed legislation of the Czech Republic, and outlines the problematic situations concerning the institute of surrogacy. The next part deals with selected case law of both the European Court of Human Rights and national courts, as well as foreign law of individual states, which intertwines with the last part of the work. It outlines the possible form of new legislation in our territory needed due to insufficient, almost zero legislation, with inspiration in the legal systems of other countries of the world.
