Diplomová práce pojednává o principu reprezentace uplatňujícím se v dědickém právu, a to převážně ve vztahu k potomkům nedědícího potomka. V první kapitole je podán výklad o základních principech dědického práva, dále přiblížení pojmu reprezentace a dělení tohoto principu. Kapitola druhá se zabývá uplatňováním reprezentace v zákonné dědické posloupnosti. Následují kapitola se věnuje reprezentaci v pořízeních pro případ smrti. Čtvrtá až sedmá kapitola se zabývají uplatňováním principu reprezentace u jednotlivých institutů dědického práva - konkrétně se jedná o vydědění, nezpůsobilosti, zřeknutí a odmítnutí dědictví. V každé z těchto kapitol je analyzována reprezentace nejen v platném právu, ale také v jednotlivých právních úpravách platných na území České republiky v průběhu dvou staletí. Poslední kapitola shrnuje poznatky ohledně uplatňování reprezentace a jeho vývoj u jednotlivých institutů dědického práva.The diploma thesis deals with the principle of representation applied in law of succession, mainly in relation to descendants of a non-inheriting descendant. The first chapter deals with the basic principles of law of succession, the approach of the concept of representation and division of this principle. The second chapter deals with the application of representation in statutory succession of heirs. The following chapter deals with representation in a mortis causa dispositions. The fourth to seventh chapters deal with the application of the principle of representation in individual institutes - specifically disinheritance, incapacity to inherit, renunciation of succession right and refusal of inheritance. In each of these chapters, representation is analyzed not only in the effective law, but also in the individual legal regulations effective in the territory of the Czech Republic over two centuries. The last chapter summarizes the knowledge about the application of representation and its development at the various institutes of law of succession.
