Aktuální problematika trvalého pobytu ve světle současné právní úpravy [rukopis] / Ludmila Rajchmanová. -- 2014. -- Oponent Monika Horáková. -- Ved. práce Lucia Madleňáková. -- Abstract: Diplomová práce se zaměřuje na aktuální úpravu trvalého pobytu dle zákona o evidenci obyvatel. Vzhledem k souvislosti s evidencí obyvatelstva je nejprve stručně vymezen historický vývoj sčítání a evidence obyvatelstva. Práce dále vysvětluje rozdíl mezi institutem trvalého pobytu a jiných podobných pojmů, které mohou působit dojmem, že jde o synonyma. Práce se také zabývá změnou a zrušením místa trvalého pobytu. Pozornost je věnována problematickým aspektům s tím spojených. Vymezeny jsou například povinnosti související s nahlášením změny trvalého pobytu, které vyplývají z dalších právních předpisů, postavení vlastníka objektu k přihlášení nebo možná podjatost ohlašovny v řízení o zrušení místa trvalého pobytu. Práce klade důraz na práva a povinnosti vyplývající z jiných právních předpisů, které váží svůj vznik na trvalý pobyt. Podrobněji jsou popsány souvislosti s aktivním i pasivním volebním právem. Prostor je věnován i problematice doručování úředních písemností se zaměřením na doručování na adresu sídla ohlašovny a možnou fikci doručení. Práce dále zmiňuje souvislost místa trvalého pobytu s ukládáním trestu zákazu pobytu dle trestního zákoníku a přestupkového zákona, přijímáním dětí do mateřských škol a místními poplatky. V práci jsou navrhována řešení problémů vyskytujících se v praxi. Práce je doplněna přílohami.. -- Abstract: The present thesis focuses on the current regulation of the permanent residence under the Law on the evidence of inhabitants. Due to the close connection with the evidence of inhabitants, the thesis firstly briefly determines the evolution of the census and evidence of inhabitants. Consequently, the thesis explains the distinction between the institute of permanent residence and other similar terms that may be confused with the term's synonyms. The thesis also discusses the acts of change and termination of the place of permanent residency. The attention is drawn to the problematic aspects linked to these two acts. Described are for example obligations connected to the announcement of the change of permanent residence, arising from other legal acts, the position of the owner of the building or the potential impartiality of the registration office in the procedure related to the termination of the permanent residency. The thesis stresses out the rights and obligations resulting from the provisions of other legal acts, triggered by the formation of permanent residence. Furthermore, the connection between active and passive right to vote is described in detail. The space for discussion is given to the issue of delivery of administrative documents with a focus on the delivery to the address of the registration office seat and the possible fiction of delivery. The thesis further elaborates the connection of the permanent residence with the penalty of residence prohibition pursuant to the Criminal Code and Code of Administrative offenses, with the acceptation of children to kindergartens and with the local fees. The thesis proposes solutions to the problems encountered in practice. The thesis is complemented with the appendices.
