Diplomová práce je zaměřena na ospravedlňování a podlomování legitimity conquisty Nového světa. Ukazuje, na jakých základech bylo stavěno právo Španělska na tato území, zaměřuje se také na postavení domorodého obyvatelstva a polemik, které se ohledně této otázky vedly. Ukazuje oba úhly pohledu, tj. proč bylo uvažováno, že dobývání a podrobování si původního obyvatelstva je oprávněné, ale také proč oprávněné být nemělo. Zabývá se také pojetím spravedlivé války. Část práce je také věnována roli španělské koruny při dobývání, právním prostředkům conquisty, ale také dokumentům upravujícím postavení domorodého obyvatelstva. Úvodní část práce je věnována také krokům conquisty, což je nutné pro seznámení čtenářů s historickým kontextem. Při zpracování práce bylo použito zdrojů převážně cizojazyčných, včetně zdrojů internetových.This graduation thesis is focused on justification and the sap of legitimacy of the conquest of the New world. It shows, on which elements was the right of Spain to this territories based. It is also focused on the situation of the natives and the polemics which are occupied by this questions. It shows two points of view: why the conquest should be justified and why not. Other aim of this thesis is the conception of the rightful war. One part of the thesis is dedicated to role of the spanish crown during the conquest, legal remedies of the conquest, and also to the documents which were controling the situation of the natives. The introduction is dedicated to all steps of the conquest, which is necessary to familiarization with the historical context. The major part of the materials I used during the elaboration of this thesis is foreign-language, including the web-based materials.
