Tato diplomová práce se zabývá právními aspekty streamování videoher z pohledu autorského práva. Práce konstatuje, že právní úprava v této oblasti není ideální, a to i z důvodu nejistoty v tom, jak je videohra právně kvalifikována. V některých zemích je videohra považována za počítačový program, v jiných za audiovizuální dílo, popřípadě jako kombinace těchto dvou možností. Tato nejistota může vést k právním problémům pro všechny zúčastněné strany, tedy pro tvůrce videoher, streamery i streamovací platformy. Práce rozebírá problematiku podřazení videohry pod úpravu autorského díla a otázku autorství. Videohra může být považována za audiovizuální dílo či na ni lze nahlížet jako na počítačový program, popř. separátně chránit herní engine (zdrojový či strojový kód) jako počítačový program a další prvky videohry jako audiovizuální dílo. Autorství videohry je v práci podřazeno pod úpravu zaměstnaneckého díla dle autorského zákona. Práce dále přibližuje problematiku licenčních smluv, přičemž zásadní prostor je použit na licenční smlouvy s koncovými uživateli (EULA), které v oblasti streamování videoher hrají zásadní roli. EULA mohou významně omezit práva streamerů na streamování videoher a lze zde najít diskutabilní ustanovení. V závěrečné kapitole se práce věnuje konkrétní streamovací platformě Twitch a podmínkám této platformy pro její uživatele, včetně povinnosti streamerů při vytváření jejich obsahu, a také licenční smlouvě s koncovým uživatelem videohry League of Legends. Závěrem práce konstatuje, že streamování videoher je důležitou právní otázkou, která si zaslouží pozornost ze strany právních odborníků, ale také ze strany samotných tvůrců videoher, streamerů a streamovacích platforem. Problematika streamování videoher je stále relativně nová a dynamicky se vyvíjející. Proto je potřeba, aby se na ni právní úprava neustále adaptovala, aby byla schopna reflektovat aktuální trendy v této oblasti.This thesis deals with the legal aspects of video game streaming from a copyright perspective. The thesis concludes that the legal regulation in this area is not ideal, partly due to the uncertainty of how a video game is legally qualified. In some countries a video game is considered a computer program, in others an audiovisual work, or a combination of the two. This uncertainty can lead to legal problems for all parties involved, i.e. video game creators, streamers and streaming platforms. This thesis discusses the issue of the classification of a video game as an adaptation of a copyright work and the question of authorship. A video game can be considered as an audiovisual work or it can be viewed as a computer program, or separately protect the game engine (source or machine code) as a computer program and other elements of the video game as an audiovisual work. The authorship of a video game is subsumed under the regulation of an employee's work under the Copyright Act. The thesis also introduces the issue of licensing agreements, with substantial space spent on end-user licensing agreements (EULAs), which play a crucial role in video game streaming. EULAs can significantly restrict the rights of streamers to stream video games, and questionable provisions can be found. In the final chapter, the thesis examines the specific streaming platform Twitch and the terms and conditions of that platform for its users, including the obligations of streamers when creating their content, as well as the end-user license agreement for the video game League of Legends. Finally, the thesis concludes that video game streaming is an important legal issue that deserves attention from legal experts, but also from video game creators, streamers and streaming platforms themselves. The issue of video game streaming is still relatively new and dynamically evolving. It is therefore necessary for the legislation to be constantly adapted to it in order to be able to reflect current trends in this area.
