Informovaný souhlas jako ospravedlnění zásahu do práva na tělesnou integritu [rukopis] / Josef Novák. -- 2023. -- s. 68 (119 968 znaků). -- Oponent Maxim Tomoszek. -- Ved. práce Jan Kratochvíl. -- Abstract: Diplomová práce pojednává o problematice informovaného souhlasu, tedy institutu umožňujícího vyloučit protiprávnost zásahu do tělesné integrity. Jejím cílem je analyzovat a přehledně popsat vybrané aspekty informovaného souhlasu v kontextu právní úpravy, odborné literatury a judikatury. První část práce sestávající z kapitoly č. 1 a 2 vymezuje především právo na ochranu tělesné integrity, k jehož ochraně slouží informovaný souhlas, a uvádí prameny právní úpravy spolu se vztahy mezi těmito prameny. Tímto je vytvořena výchozí pozice pro další zkoumání vybraných aspektů informovaného souhlasu v kapitolách č. 3 a 4, kde již jsou zodpovězeny konkrétní výzkumné otázky. Ve druhé části práce se zabýváme konkrétními aspekty informovaného souhlasu. Kromě právních a odborných pramenů je použita i judikatura, která slouží k osvětlení rozhodovací praxe soudů. Tímto je spojen teoretický a praktický rozměr práce. K některým problematickým otázkám rovněž navrhujeme vlastní řešení nebo alespoň navrhujeme otevření odborné debaty o těchto problémech. Kapitola č. 3 zkoumá především náležitosti informovaného souhlasu jako právního jednání. Kapitola č. 4 zkoumá poučování, jehož řádnost je nezbytným předpokladem pro platnost informovaného souhlasu.. -- Abstract: The diploma thesis deals with the issue of informed consent, i.e. the institute allowing to rule out the illegality of interference with bodily integrity. Its goal is to analyze and clearly describe selected aspects of informed consent in the context of legislation, professional literature and jurisprudence. The first part of the thesis, consisting of chapters No. 1 and 2, primarily defines the right to the protection of bodily integrity, which is protected by informed consent, and lists the sources of legal regulation together with the relationships between these sources. This creates a starting position for further investigation of selected aspects of informed consent in chapters No. 3 and 4, where specific research questions are already answered. In the second part of the thesis, we are already dealing with specific aspects of informed consent. In addition to legal and professional sources, jurisprudence is also used, which serves to illuminate the decision-making practice of the courts. This combines the theoretical and practical dimensions of the work. We also propose our own solutions to some problematic issues, or at least we propose the opening of a professional debate on these problems. Chapter No. 3 mainly examines the essentials of informed consent as a legal action. Chapter No. 4 examines the instruction, the correctness of which is a necessary prerequisite for the validity of informed consent.
