Tato práce pojednává o tom, zda je možné a v jakých případech je možné vybočit ze standardních postupů zavedených ve vykonávacím řízení. Konkrétně řeší diplomová práce, co se stane, pokud existuje vykonatelný exekuční titul upravující poměry nezletilého dítěte, přičemž oba rodiče nemají s výkonem rozhodnutí problém, ale nezletilé dítě se tomuto výkonu brání a vysloví s ním nesouhlas. Diplomová práce má odpovídat na otázku, zda dosahuje nesouhlas dítěte takové intenzity, že je možné jej podřadit pod důvod zastavení výkonu rozhodnutí podle ustanovení § 268 odst. 1 písm. h) OSŘ. Na tuto otázku diplomová práce odpovídá v kontextu judikatury Ústavního soudu. Diplomová práce nejprve vymezuje, jakou roli zastává Ústavní soud v případě, je-li obecnými soudy rozhodováno o poměrech nezletilých dětí. Následně potom provádí analýzu dvou nálezů Ústavního soudu, kdy společným znakem obou je to, zda lze aplikovat v daném případě výše citovaný důvod pro zastavení výkonu rozhodnutí jako následek nesouhlasu nezletilého s výkonem exekučního titulu. Kolize spočívající mezi formálností vykonávacího řízení a nesouhlasem dítěte jako subjektu řízení, o kterém je pojednáváno, je zde řešena tak, aby vykonávací řízení mohlo dospět svému účelu, kterým je vymožení stanovené povinnosti, ale zároveň aby byl brán zřetel na to, že dítě je subjektem práva mající svá práva, mezi které řadíme například právo na informace a právo vyslovit vlastní názor a přání, jež má být předním hlediskem při rozhodovací činnosti soudů. Práce se tedy pokouší stanovit jasný postup soudům tak, aby nedocházelo k excesům, kdy se zde budou nacházet rozhodnutí, která nelze vykonat, přičemž se taková řízení vlečou další roky, čímž značně negativním způsobem ovlivňují současný i budoucí život a celý vývoj nezletilého dítěte.This thesis deals with whether it is possible, and in what cases it is possible, to move away from the standard procedures established in enforcement proceedings. In particular, the thesis addresses what happens if there is an enforceable title regulating the circumstances of a minor child. This child's parents have no problem with the enforcement, but the minor child resists and disagrees with that performance. The thesis is intended to answer the following question. Does the child's disapproval reach an intensity that can be subdued under the reason for stopping enforcement pursuant to the provisions of Section 268 (1) of the CDS. This question is answered by the thesis in the context of the case law of the Constitutional Court. The thesis first defines the role played by the Constitutional Court in the case where the ratios of minor children are decided by ordinary courts. Subsequently, it carries out an analysis of two findings from the Constitutional Court. One where the common feature of both is whether the above-mentioned reason for stopping enforcement can be applied in the case as a result of the minor's opposition to the enforcement of the enforceable title. Two the conflict between the formalness of the enforcement proceedings and the disapproval of the child as the subject of the proceedings in question is dealt with in such a way that the enforcement procedure can achieve its purpose. The purpose being to enforce the obligation laid down, but at the same time, take into account that the child is a subject of law having rights. Which include, for example, the right to information, the right to express one's own opinion and wishes, and the right to be a leading consideration in the decision-making activities of the courts. The work therefore attempts to establish a clear procedure for the courts so as not to create excesses, where decisions that cannot be enforced are found. When these such proceedings drag on for years and years, they significantly negatively affect the current, future life, and the entire development of the minor child.
