Institut prvního setkání se zapsaným mediátorem [rukopis] / Petra Mašková. -- 2020. -- 119890. -- Oponent Klára Bartoníčková. -- Ved. práce Lenka Holá. -- Abstract: Tato diplomová práce s názvem Institut prvního setkání se zapsaným mediátorem se zabývá zákonným oprávněním předsedy senátu nařídit účastníkům soudního řízení setkání s mediátorem. K naplnění tohoto tématu byl stanoven cíl práce, a to identifikace a analýza problematických oblastí institutu prvního setkání se zapsaným mediátorem se zaměřením na zkoumání příčin problémů a zhodnocení jejich důsledků pro praxi. První kapitola je věnována vymezení základních pojmů, se kterými je v dalším průběhu práce pracováno. Druhá kapitola je zaměřena nejen na tuzemskou právní úpravu institutu, ale i na úpravu zahraniční, a to z důvodu, že závěrečná diskuse je věnována komparaci české právní úpravy se zahraniční úpravou. Pro tuto práci byla zvolena právní úprava Velké Británie a Itálie. Obsahem třetí kapitoly je diagnostika případů účelných a vhodných k mediaci, tj. zde je věnován prostor pro určení případů vhodných či nevhodných k mediaci. Závěrečná kapitola je věnována určení problematických oblastí při aplikaci prvního setkání. Z uvedeného důvodu se jedná o stěžejní část celé diplomové práce. Závěr diplomové práce je spojen s diskusí, která se zaměřuje na vymezení určitých problematických oblastí a jejich porovnání se zahraniční právní úpravou.. -- Abstract: This diploma thesis called the Institute of the First Meeting with a Registered Mediator deals with the legal right of the chairman of the court to order the parties to the court proceedings to meet with a mediator. To fulfill this topic, the aim of the work was to identify and analyze the problematic areas of the institute of the first meeting with a registered mediator with a focus on investigating the causes of problems and evaluating their consequences for practice. The first chapter is devoted to the definition of basic concepts, which is in the course of work. The second chapter is focused not only on the czech legal regulation of the Institute, but also on the foreign one, because the final discussion is devoted to the comparison of the Czech legislation with the foreign regulation. The legislation of Great Britain and Italy was chosen for this work. The content of the third chapter is the diagnosis of cases useful and suitable for mediation, i.e. there is a space for determining cases suitable or inappropriate for mediation. The final chapter is devoted to identifying problem areas in the application of the first meeting. For this reason, it is a main part of the whole thesis. The conclusion of the thesis is connected with the discussion, which focuses on the determination of certain problem areas and their comparison with foreign legislation.
