Diplomová práce (dále jen "práce") na téma efektivní realizace participačních práv dítěte v agendách Úřadu pro mezinárodněprávní ochranu dětí reflektuje některé vybrané problémy v participační praxe v kontextu s efektivní realizací participačních práv dítěte v agendách Úřadu pro mezinárodněprávní ochranu dětí. V úvodu práce jsou popsány zejména vybrané základní pojmy a jejich zakotvení v právní úpravě vnitrostátní i mezinárodní úrovni, přičemž v návaznosti na něj jsou zpracovány tři podkapitoly, zabývající se jednotlivými fragmentárními problémy, které vyplývají z praxe. Každá podkapitola je objektivně zhodnocena dílčím závěrem. Text teoretické části je členěn do tří podkapitol, přičemž ve třetí kapitole nabízím tři problematické okruhy, tedy jak jsou participační práva realizována, jak je zjišťován skutečný názor dítěte a jak koresponduje nejlepší zájem dítěte s jeho participačními právy. Tyto problémy mají svoje dílčí závěry, které tvoří s druhou praktickou kapitolou výstup do závěru. Druhá praktická část práce reflektuje v souladu s odpověďmi jednotlivých pracovníků na úřadu na dotazník, jenž je přílohou práce a předestírá, jakým způsobem je dnes na participační praxi nahlíženo a nabízí pohled praktikujících právníků v kontextu s judikaturou a odbornými články. Tato kapitola je o dobré praxi úřadu, o problémech v souvislosti s praxí úřadu i jednotlivými zaměstnanci. V závěru nabízím shrnutí na tuto problematiku a možná řešení de lege ferenda. Cílem diplomové práce je podat fragmentární pohled na problematiku participačních práv dítěte, analyzovat jednotlivá východiska a úrovně participace v kontextu s praxí a navrhnout dílčí řešení pro lepší aplikaci těchto práv v praxi.The master's thesis deals with the topic Effective realisation of the participative child's laws in the agendas of Office for International Legal Protection of Children. The thesis reflects chosen problematic of participatory practices in the context of effective realisation of participatory child's laws in selected agendas of Office for International Legal Protection of Children. The beginning of the thesis is descriptive and it is focused on the basic definition of selected terms and their impact in international and internal law systems. The first chapter is followed by three subchapters with the focus on fragmental problems based on the practice. Every subchapter is evaluated and summarized. The theoretical part is divided into three subchapters, too. In the third chapter, there is evaluative and the focus of the third chapter is on three problematical aspects of the realisation of participatory laws, it means how the children's will is expressed, projected and how it corresponds with the best interest of the child and its participatory laws. This problematic has its own partial results which composes the second practical chapter. The second practical part of the thesis reflects answers of the responsible authorities on questionnaire. Questionnaire and answers is an attachment of the thesis. Questionnaire offers the possibility to understand how law's practitioners works in the line with case law and articles. The chapter is not only about the good practices, but also about individual and/or institutional limits. At the end, the thesis offers summary of the topic and possible solutions de lege ferenda. The aim of the thesis is to provide fragmental insight into the topic of participatory child's laws. Additional aim is to analyse possible outputs and the levels of participation in the line with practice and to offer possible particular solutions for better implementation of the laws.
