(119 377 znaků). -- Oponent Klára Bartoníčková. -- Ved. práce Jana Křiváčková. -- Abstract: Předmětem diplomové práce je zkoumání právní úpravy oddlužení, zejména podmínek přípustnosti jeho využití, a to s ohledem na zachování principu poctivosti, který představuje primární těžiště posuzování jednotlivých vybraných aspektů. Vzhledem k tomu, že k prolnutí oddlužení a principu poctivosti, což je ústřední myšlenka této práce, je nezbytné nalézt jejich smysl a účel, úvodní kapitoly této práce jsou věnovány právě rozboru těchto klíčových pojmů. Dalším stěžejním bodem této práce je analýza soudních rozhodnutí za účelem zjištění přístupu insolvenčních soudů ke zkoumání existence nepoctivého záměru u dlužníka, který má vůli změnit svoji ekonomickou situaci prostřednictvím oddlužení. Důraz je kladen také na možnosti předcházení úpadku fyzických osob a závěrem práce je rozebrána novela insolvenčního zákona přinášející významné změny.. -- Abstract: The subject of this thesis is the examination of the legal regulation of debt relief focusing mainly on the conditions for the admissibility with regard to the preservation of the principle of honesty which represents the primary point for the assessment of the selected aspects. Thus, the mutual relationship between the debt relief and the principle of honesty is the main idea of this thesis, it is necessary to find their meaning and intended purpose as this is addressed in the first chapters of this thesis. Another primary point of this thesis is the analysis of the court decision in order to examine the opinion of the insolvency courts regarding the existence of the debtor's dishonest intentions while trying to change his economic situation through the debt relief. The focus of this thesis is also the individual possibilities to prevent the individuals from the bankruptcy and identifying the significant changes made due to the amendment of the Insolvency Act.
