(86 892 znaků). -- Oponent Jiří Jirásek. -- Ved. práce Marian Kokeš. -- Abstract: Bakalářská práce je zaměřena na analýzu ústavního přezkumu rozhodnutí o amnestii bývalých prezidentů Václava Klause a Vladimíra Mečiara. Úvodem se věnuje vymezení rozdílů mezi individuální milostí a amnestií a jejich forem, dále okrajově nastiňuje historický vývoj od vzniku České republiky po současnost. Práce rovněž pojednává o české a slovenské právní úpravě amnestie. Ve stěžejní části je proveden rozbor konkrétní judikatury ve vztahu k výše uvedeným rozhodnutím, jakož i jednotlivé skutkové okolnosti obou případů. Cílem této práce je následně porovnat soudní přezkum amnestií v ČR a SR, pokusit se vymezit některé problematické otázky s institutem amnestie spojené a navrhnout úpravu de lege ferenda.. -- Abstract: This bachelor thesis focuses on the analysis of the constitutional review of the presidential amnesty of Václav Klaus and Vladimír Mečiar. In the introductory part, it contains demarcation of differences between an individual pardon and an amnesty and their forms, next the thesis marginally outlines the historical development from the formation of the Czech Republic to the present time. The work also deals with the Czech and Slovak amnesty legislation. In the key part, there is the analysis of the specific case-law in relation with the stated judgments, as well as the facts of both cases. The aim of this thesis is the comparison of the judicial review of amnesty in the Czech and Slovak Republic, the attempt to define the problematic questions related to amnesty and propose legislation de lege ferenda.
