Tato diplomová práce se zabývá ochrannými opatřeními, konkrétně ochranným léčení a zabezpečovací detencí. Ochranná opatření jsou spolu s tresty jednou z trestních sankcí. České právo zná čtyři druhy ochranných opatření ochranné léčení, zabezpečovací detenci, zabrání věci a ochrannou výchovu. Tato práce se zabývá prvními dvěma druhy těchto ochranných opatření. Diplomová práce je rozdělena do devíti kapitol. První kapitola obsahuje stručný úvod. Druhá se zabývá trestními sankcemi obecně, srovnáním trestů a ochranných opatření. Třetí kapitola obsahuje ochranné léčení. V této kapitole byl proveden výzkum, který byl proveden v severních Čechách. Čtvrtá kapitola obsahuje problematiku zabezpečovací detence. Pátá kapitola obsahuje srovnání české právní úpravy s australskou a novozélandskou právní úpravou těchto dvou ochranných opatření. Závěr jako sedmá kapitola obsahuje shrnutí aktuální právní úpravy a jejích nedostatků. V dalších kapitolách následuje bibliografie, shrnutí a klíčová slova.This thesis deals with protective measures, specifically with protective treatment and security detention. Protective measures are one of the criminal sanctions, as well as sentences. Czech law knows four kinds of protective measures - protective treatment, security detention, seizure of an item and protective rehabilitation. This thesis addresses the first two types of protective measures. The thesis is divided into nine chapters. The first chapter provides a brief introduction. The second chapter deals with criminal sanctions in general, deals with a comparison of sentences and protective measures. The third chapter deals with the protective treatment, including a research which was made in northern Bohemia. The fourth chapter deals with protective detention. And finally, the fifth chapter describes the comparison between the czech version of these two types of protective measures and the australian and new zealand version of these two protective measures. The seventh chapter called Conclusion then mainly contains a summary of some of the shortcomings in current arrangements and its lacks and gaps. In the next chapter is followed by a bibliography, as well as summaries and key words.
