Tato kvalifikační práce je zaměřena na komparaci obecní policie a Policie České republiky. Zabývá se rozdíly v jejich vzniku, právní úpravě, působnosti a zejména v povinnostech a oprávněních. Speciální kapitola je věnována rozdílům v oprávnění k použití donucovacích prostředků, a to včetně zbraně. V tomto směru práce rovněž reflektuje zkušenosti a názory strážníků obecní policie a příslušníků Policie České republiky. Poslední kapitola je věnována úvahám de lege ferenda. Cílem práce bylo ověřit, zda mají strážníci obecní policie a příslušníci Policie České republiky stejná oprávnění a povinnosti. Rovněž zda jsou oprávněni použít tytéž donucovací prostředky, nebo zda je někdo z nich ve výběru donucovacích prostředků omezen. K dosažení zamýšleného cíle byla využita metoda deskriptivní, výkladu práva, individuálního ústního dotazování a komparace.This thesis is focused on comparison between the municipal police and The Police of the Czech Republic. It deals with the differences in their establishment, legal regulations, competence and especially in duties and authorizations. A special chapter is dedicated to the differences in authorization to use repressive instruments, including a weapon. In this respect, the work also reflects on the experiences and opinions of the constables of the municipal police and police officers of the Police of the Czech Republic. The last chapter is dedicated to considerations de lege ferenda. The aim of the thesis was to verify whether the constables of the municipal police and police officers of the Police of the Czech Republic have the same rights and duties. Also, whether they are entitled to use the same repressive instruments, or whether any of them is restricted in a choice of repressive instruments. To achieve the intended goal, the descriptive method, the interpretation of the law, the individual oral questioning and the comparison were used.
