    Diplomova prace se venuje drevinam rostoucim mimo les v sousedskych sporech. Autorka deli praci na tri casti a to na verejnopravni upravu, soukromopravni upravu a konecne na nezavislost uplatnovani soukromeho prava na pravu verejnem. Prace proto vychazi jak z norem soukromeho, tak i z norem verejneho prava. Zejmena z obcanskeho zakoniku a zakona o ochrane prirody a krajiny. Autorka se zabyva kacenim drevin, s nim souvisejicim povolovacim resp. oznamovacim rezimem a dusledkum nedovoleneho kaceni. Mimo jine take analyzuje moznosti ochrany vlastnika pozemku proti zasahu do jeho vlastnickeho prava zpusobeneho stromem rostoucim na pozemku sousednim. Na pripadu drevin rostoucich mimo les v sousedskych sporech je demonstrovano prolinani a ovlivnovani soukromeho a verejneho prava. Pricemz je vytvaren kriticky pohled na upravu nezavislosti uplatnovani techto dvou odvetvi tak, jak je to proklamovano v § 1 obcanskeho zakoniku. Kriticky pohled je take vyvinut na upravu ustanoveni tykajicich se sousedskeho prava a na jejich uplatnovani v souvislosti s povolovacim rezimem kaceni drevin rostoucich mimo les tak, jak ho stanovuje zakon o ochrane prirody a krajiny. V teto souvislosti jsou predlozeny pripady z praxe a judikatura tykajici se tematu diplomove prace. Prace ma diky nastineni pripadnych uskali pri aplikaci ustanoveni i prakticky ramec. Autorka prezentuje v prubehu celeho textu sve nazory na jednotlive casti problematiky a navrhuje moznosti lepsiho reseni ci jeji vhodnejsi upravu.This diploma thesis is dealing with trees growing outside of forest areas in neighbour disputes. The author divided the thesis in three parts public law arrangements, private law arrangements, and last but not least the independence of the application of private law regardless of the public law. The text is therefore considering private law provisions as well as public law provisions, mainly the Civil Code and The Act of Protection of Nature and Landscape. The author is discussing the felling of trees and the associated authorization aka notification regime and the consequences of unauthorized felling. In addition, it analyses the possibilities of protection of the land owner in case of an interference of his property rights caused by a neighbour's tree. The issue of trees growing outside of forest areas in neighbour disputes demonstrates the overlapping and the influence between private and public law. The independence of the application of private law regardless of the public law as stated in § 1 of the Civil Code is critically challenged. The thesis also looks at the provisions regarding neighbour law and their application in the authorization regime of felling of trees growing outside of forest areas as described in The Act of Protection of Nature and Landscape. Real life cases as well as case law are discussed in regards to the topic of this thesis. The thesis contains practical framework as a result of pointing out the problems connected to the application of the provisions. The author is providing her own thoughts regarding various issues throughout the whole text and provides suggestions on better solutions or better legal arrangements.
