Toto téma jsem si zvolila z důvodu trvající aktuálnosti a společenské závažnosti. Domácí násilí patří ve společnosti mezi velmi sledovaná témata a také právní úpravě této problematiky je třeba věnovat náležitou pozornost. Ve své diplomové práci a konkrétně její úvodní části jsem se zabývala obecnou problematikou domácího násilí. Zaměřila jsem se převážně na prostředky ochrany proti domácímu násilí v právním řádu ČR. Poté následuje analýza charakteristiky domácího násilí jako fenomén dnešní doby, zejména je popsán pojem domácího násilí, jeho znaky a formy. Diplomová práce se také stručně zaměřila na intervenční centra, jakožto organizace vytvořené s cílem pomáhat obětem domácího násilí. V této kapitole jsem zkoumala konkrétně to, jak intervenční centra fungují a jaký je vztah mezi těmito specializovanými centry a možnostmi právní ochrany. V analytické části své diplomové práce jsem věnovala největší pozornost současné soukromoprávní regulaci domácího násilí a institutům ochrany oběti před domácím násilím napříč právním tuzemským řádem. Zaměřila jsem se především na klady a zápory právní úpravy a institutů a navrhla jsem, dle závěru, efektivnější způsob ochrany oběti před pachatelem. Diplomová práce se podrobněji zabývá institutem vykázání a předběžného opatření ve věci ochrany proti domácímu násilí. Zmínila jsem se také o trestněprávní a správní úpravě, jakožto regulaci, která jde ruku v ruce s ochranou soukromoprávní. Použité statistické údaje poskytují klíč ke shrnutí efektivity prostředků ochrany proti domácímu násilí.I chose this topic because of the lasting contemporaneity and social importance. Domestic violence is one of the high-profile topics in today's society. Legislation pertining to domestic violence needs be given its due diligence.. In this thesis, specifically the introduction, I discussed the general issues of domestic violence. More specifically, I focused on the means of protection against domestic violence in the Czech legal order. Furthermore, this thesis delves into the characteristics of domestic violence, which portray it as a current phenomenon. Hence, there is especially explained the concept of domestic violence, its characters, its forms and causes and lastly victim of domestic violence. This thesis is also briefly focused on intervention centers, as an organization created to help victims of domestic violence. In this aforementioned topic, I examined, specifically, how the intervention centers work and what is the relationship between these specialized centers and possibilities of legal protection. In the analytical part of my thesis, I primarily focused on the current regulation of private institutes of domestic violence and protection of victims from domestic violence across the domestic legal order. I focused on the advantages and disadvantages of legislation and institutions. According to conclusion, I deduced a more efficient way to safeguarding a victim from their offender. This thesis deals in details with the police restraining order and preliminary injunction to protect victims against domestic violence. Furthermore, I also stated the regulations pertaining to criminal and administrative arrangements, which go hand in hand with the civil protection. Finally, the statistical data provide a comprehensive summary that shows the effectiveness of the means of protection against domestic violence.
