Diplomová práce se věnuje problematice autorských a závazkových práv k stavebním architektonickým dílům vytvářeným na objednávku. Práce rozebírá vztah architektury a práva. Podává přehled právní úpravy a obecný úvod do problematiky autorských práv v architektuře. Věnuje se otázkám vzniku stavebního architektonického díla a jeho druhům. Podává informace o autorství. Podrobně analyzuje skutečnost vzniku díla ze smlouvy o dílo a uvádí ujednání, která by ve smlouvě o dílo neměly chybět. Rozebírá otázky poskytování licencí a práva dílo užít či změnit. Práce je doplněna o příklady, judikaturu a v praxi řešené spory.This thesis is focused on the issues of authorship and obligation rights to an architecture works created on an order. The thesis analyses the relation between architecture and law. It gives a summary of concerned legislation and general introduction to the problematic of authorship rights in architecture. The thesis is handling with creation of architectonic work and defines their possible types. There are information concerning authorship of the work and as well there is detailed analyse of a contract for work on which bases is the piece of work created. There are also recommendations how to arrange mutual rights and duties between the architect and his client. Next part is about licence providing the architectonic work and about the right to use and change appearance of the architectonic work. There is a list of a case law as well.
