Diplomová práce na téma "Kybernetická kriminalita páchaná na dětech" pojednává o druzích internetové kriminality, pokouší se vymezit hranice bezpečného internetu a poukazuje na nutnost spolupráce mezi státy. Shrnuje podmínky, za jakých může internet sloužit jako nástroj k páchání trestné činnosti, zejména z hlediska pořizování a uchovávání dětských pornografických materiálů a pohlavního zneužívání dětí. Zabývá se jevy v kyberprostoru, kde jsou děti vystaveny také riziku kyberšikany či kyberstalkingu. Poukazuje na potencionální nebezpečí, vyplývající z užívání sociálních sítí, kde se děti stávají snadnou kořistí sociálních inženýrů. Práce vychází z aktuální právní úpravy obsažené v trestním zákoníku, zejména rozboru skutkových podstat dopadajících na tento poněkud nový druh kriminality. Obsahuje vymezení základních pojmů, rozebírá hmotněprávní trestní úpravu, procesní hlediska a specifika spojená s postihem těchto jevů, včetně zaměření se na prevenci kriminality. Text je členěn do dvanácti kapitol, ve kterých jsou podrobeny rozboru obecná rizika internetu až po konkrétní trestné činy, jako je kybergrooming a on-line dětská pornografie. Zahrnuje zajímavou příkladnou kazuistiku, poukazuje na britskou právní úpravu a její součástí je kvantitativní výzkum o chování dětí na internetu. Práce obsahuje celkový pohled na problematiku, včetně úvahy o možném předcházení trestné činnosti.The thesis "Cybercrime Against Children" deals with the types of Internet crime; it specifically tries to define the limits of the safe usage of the Internet and stresses the need of cooperation among the individual countries. Further, the thesis summarizes the conditions under which the Internet can serve as a tool for committing a crime, such as as gaining and storing children pornographic content and sexual abuse of children. Moreover, the paper analyzes cyber phenomenons which expose the children to the risk of cyberbullying or cyberstalking. To be more precise, it discusses the potential danger of social networks where children become an easy prey of social engineers. The work is based on current legislation encompassed in the Criminal Code: particularly, on the analysis of the state of the facts of this rather new kind of criminality. The thesis defines the basic concepts, discusses the substantive criminal law and the procedural aspects, including specific sanctions. It also suggests the potential crime prevention. The thesis consists of twelve main chapters, which analyze the potential solutions of the general risks of the Internet, as well as examine specific crimes, namely cybergrooming and online child pornography. Furthermore, the thesis contains an interesting set of cases, provides the basic frame of the British legislation on the issue and last but not least, it introduces a quantitative research that was conducted on the characteristics of children behaviour on the Internet. The paper reflects a holitstic approach towards the discussed issue, including the potential methods of prevention of the afore mentioned crime.
