Tématem diplomové práce jsou způsoby vzniku a zániku států s důrazem na současné dění v mezinárodním právu veřejném. Ve své práci obecně popisuji základní pojetí státu coby základního subjektu mezinárodního práva s poukazem na jeho charakteristiku a historii v komparaci se současným stavem. Dále se věnuji jednotlivým způsobům vzniku států spolu s analýzou uznání států a práva národů na sebeurčení proti vůli územního suveréna. Osvětluji rovněž problematiku zániku státu a jeho faktické a právní důsledky v mezinárodním právu. Ve zvláštní části se odborně zaměřuji na jednotlivé případové studie - vyhlášení nezávislosti Kosova, vznik Jižního Súdánu na základě referenda a o možném budoucím právním statusu Quebecu a Palestiny.The topic of diploma thesis are methods of the creation and the extinction of states with emphasis on current happening in international public law. In my thesis, I generally describe the basic concept of a state as a basic subject of international law with reference to its characteristic and history in comparison with the current situation. Next I analyze the individual modes of the creation of states with the question of recognition of states and the question of the right of nations to self-determination against the will of the territorial sovereign. Also I explain the issue of extinction of states and its factual and legal consequences in the international law. In a special part, I professionally focus on individual case studies - the declaration of independence of Kosovo, the creation of South Sudan following by referendum and possible future legal status of Quebec and Palestine.
