Předmětem této diplomové práce je pojednání o problematice ochrany zahraničních investic v EU. Oblast ochrany zahraničních investic je jednou z nejprogresivnějších oblastí mezinárodního práva vůbec, vždyť celosvětově mezinárodní investiční instrumenty dosahují počtu 6000. V důsledku globalizace došlo k prudkému nárůstu pohybu zahraničních investic a nejenom vyspělé, ale i rozvojové země se stávají zdrojem zahraničních investic. Obecně můžeme říci, že jsou státy EU vázány smlouvami o podpoře a vzájemné ochraně investic uzavřenými buď mezi dvěma členskými státy nebo mezi členskou zemí a nečlenskou zemí. Diplomová práce reaguje na změny provedené Lisabonskou smlouvou, která udělila EU výlučnou pravomoc v oblasti přímých zahraničních investic, a tím začlenila přímé zahraniční investice do společné obchodní politiky.The subject of this thesis is an essay about the area of protection of foreign investment in the EU. Globally, the number of international investment instruments reaches almost 6000. Globalisation has seen a dramatic increase of movements of interantional investments and not only developed, but also developing coutries have become the source of international foreign investments. Generally speaking, Member States are bound by agreements on the protection and promotion of investment reached either between two Member States or between member countries and non-member countries. This thesis addresses the changes made by the Lisbon Treaty, which granted the EU's exclusive competence in the area of foreign direct investment, and thus include foreign direct investment in the common commercial policy.
