Cílem diplomové práce je, vypracovat, vytvořit určitý metodický postup, či návod pro vedení správního řízení na úseku evidence obyvatel ohlašovnami, předně správního řízení o zrušení údaje o místu trvalého pobytu dle ust. § 12 odst. 1 písm. c) zákona o evidenci obyvatel (dále jen "řízení na návrh"). Tato práce popisuje evidenci obyvatel od jejich historických počátků po současnou právní úpravu. Práce podrobně rozebírá a popisuje současný právní předpis na úseku evidence obyvatel a jeho jednotlivé instituty. Práce následně v dalších částech vymezuje čtyři typy správních řízení na úseku evidence obyvatel. Podrobně potom ve vazbě na správní řád analyzuje nejsložitější typ řízení, tj. řízení na návrh. V rámci této části jsou podrobně analyzovány a vysvětleny zákonné postupy a úkony správního orgánu v tomto typu řízení. Jsou doplněny a dokresleny formou zpracovaných vzorů podání a úkonů správního orgánu a také tabulek, vysvětlujících počítání času, oznamování rozhodnutí i nabytí právní moci rozhodnutí. Tyto vzory a tabulky jsou začleněny do přílohy diplomové práce. Příloha obsahuje také diagram, který přehledně znázorňuje celý proces tohoto správního řízení. Postupy rozpracované v řízení na návrh jsou použitelné i pro ostatní typy řízení na úseku evidence obyvatel. Závěrečná kapitola práce je věnována vzdělávání úředníků, jako nezbytné součástí kvalifikace a odbornosti úředníka samosprávného celku. Takto vytvořená metodická pomůcka může být využívána pracovníky správních orgánů, ohlašoven, při vedení všech typů správního řízení na úseku evidence obyvatel.The aim of this thesis is to create methodical procedure or instruction on how to lead administrative hearing at the section of inhabitants registration by registration offices. This methodical procedure or instruction should be primarily focused on administrative hearing of canceling the permanent residence according to the Act on inhabitants registration, § 12, section 1 c) (further referred as "proposal hearing"). The thesis describes how the registration of inhabitants has evolved from its historical origins into nowadays legal form. In details it analyzes this legal form in the area of the registration of inhabitants. Moreover, it describes the legal form and its particular institutes. The thesis defines four types of administrative hearings at the section of the registration of inhabitants. Closely and in relation to the administrative hearing it examines the most complicated type of hearing that is the so called proposal hearing. In this part the thesis inspects and explains at large the legal procedures and acts of the administrative body in this type of hearings. Templates of proposals and acts of the administrative body together with tables explaining counting the time, communicating the decision as well as legal validity of decision are provided as attachments to this thesis. Diagram illustrating the entire process of the administrative hearing is enclosed too. Procedures elaborated in the proposal hearing are applicable to other types of hearings at the section of the registration of inhabitants. The final section of this thesis is focused on education of civil servants that represents fundamental part of civil servants qualification and proficiency. The methodical instrument created in this thesis might be used by administrative body staff and by registration offices in all types of administrative hearings at the division of the registration of inhabitants.
